Every insured with a balance in the FGTS account (Fundo de Garantia do Tempo de Serviço) is entitled to withdraw the funds deposited in the Guarantee Fund when he retires. If the retiree who works changes jobs, the FGTS continues to be deposited, but it can only be withdrawn when the contract is completed or terminated.
Santos says that workers should be aware of their rights and monitor whether employers continue to deposit the FGTS if the employee is removed due to an accident at work — which does not happen in the case of leave due to an accident of non-occupational origin.
How to withdraw FGTS
The main document needed to withdraw the FGTS is the withdrawal certificate that the INSS sends with the granting letter. According to Joseane Zanardi, a lawyer and coordinator of the IBDP (Brazilian Institute of Social Security Law) in the state of São Paulo, this document must be delivered to the insured, on average, within 20 days after the granting of retirement.
In a note, Caixa informs that, upon retirement, the worker can withdraw amounts from all FGTS accounts with a balance whose admission date is before the DIB (Benefit Start Date).
