The Chamber of Deputies approved this Wednesday (31) a provisional measure that reopens until November 30 the deadline for active servants to migrate to the supplementary pension through Funpresp.
The basic text was approved in a symbolic vote. Deputies rejected suggestions for change. The MP goes to the Senate, where it needs to be voted on by October 5th so as not to lose its validity.
In the Chamber, the text was reported by the government leader in the House, Ricardo Barros (PP-PR).
The public employee pays an additional to receive a supplementary benefit, in addition to retirement, limited to the Social Security ceiling, which is R$ 7,087.22 in 2022.
The new migration deadline is valid for Executive servants who were hired before February 4, 2013 and for Judiciary workers who entered before May 7, 2013.
This is because membership is mandatory for civil servants who entered after these dates, in the case of those who earn more than the social security ceiling. In this regime, the worker pays 7.5%, 8% or 8.5% on what exceeds the Social Security ceiling and the government pays the same percentage (counterpart).
The text of the MP states that the option for the supplementary pension is irrevocable and irreversible and also emphasizes that “the Union, nor by its autarchies and public foundations, will not be owed any consideration referring to the value of discounts already made on the contribution base above the maximum limit established for the benefits of the General Social Security System.”
The provisional measure updates the rules for calculating the special benefit that will be paid by the supplementary regime based on what was approved in the Social Security reform, which came into effect in 2019.
For those who join this year, the calculation of the special benefit will take into account all employee contribution salaries since July 1994. For those who joined until 2021, the account considers the 80% highest salaries, discarding the 20 % smaller.
The MP also changes a provision on remuneration and benefits of members of the executive boards of closed supplementary pension entities. According to the text, both will be established by their deliberative councils, at values compatible with what is practiced in the labor market for professionals with equivalent degrees of professional training and specialization.
The provision, however, removes an existing part of the current law that says that remuneration and benefits must comply with the constitutional ceiling rule.
“What this provisional measure is doing is opening a new gate so that servers, in this case, Funpresp, receive above the salary ceiling”, said the leader of Novo in the Chamber, Tiago Mitraud (MG), who highlighted the removal of the PM excerpt.
Deputy Kim Kataguiri (União-SP) also criticized the device. “What the Bolsonaro government is guiding is that pension fund managers are allowed to receive more than R$39,000, which takes managers out of the constitutional ceiling,” he said.
“Let voters remember that, in the middle of the election, in a period of crisis, Bolsonaro not only increased taxes yesterday, he made credit more expensive for the entrepreneur, as today the deputies from the base of the government are saying that with this tax increase you will pay a salary of R$ 75 thousand”, he said. The deputies, however, rejected the suppression.

On the Funpresp website, the system informs that this is the fourth window of migration of the social security system and offers the scheduling of an appointment with the social security advisors of the fund, who will provide advice to the server.
