President Jair Bolsonaro (PL) sanctioned, with vetoes, the law that creates a program to encourage the replacement of the old fleet of trucks and buses in circulation in Brazil.
The text allows oil and gas exploration and production companies to withdraw research and innovation money to apply to the renewal of the fleet of trucks and buses.
Symbolically approved in Congress in August, the measure will return for analysis by parliamentarians, who will have the final word on the law.
Originating from a provisional measure, the legislation creates Renovar, a program that seeks to aggregate initiatives to progressively remove end-of-life vehicles and encourage the renewal of the fleet of trucks, buses and vans.
The sanction takes place less than a month before the elections, in which Bolsonaro is seeking reelection, but is in second place in the polls.
The section that allows companies to withdraw money from research and innovation has been kept. “The contractors for the exploration and production of oil and natural gas will be able to apply resources to promote the renewal of the circulating fleet within the scope of the Program to Increase the Productivity of the Road Fleet in the Country (Renovar)”, says the law.
Bolsonaro vetoed three provisions, at the request of the Ministry of Economy, as he understood that they would imply a waiver of revenue.
The text approved by parliamentarians provided for a more favorable interest rate for companies participating in the program. Among the reasons for barring the benefit, the ministry claimed that it would lead to a reduction in revenues and contradict the LDO (Budget Guidelines Law of 2022)
“Additionally, it should be noted that the measure would imply an increase in the Union’s credit subsidy through the FAT in a context of fiscal restriction and would represent a possible compromise of the structure of the composition of the TLP, which would constitute a relevant fiscal risk”, says the Economy.
One of them determined that the legal entity that hires a cargo transport service could deduct credits calculated in relation to the individual, an autonomous carrier, and to the legal entity, through Simples (Integrated Tax and Contribution Payment System).
The government claims that the measure expands the scope of legal entities subject to usufruct of credit related to Cofins and would reduce tax collection.
Another passage said that the importing legal entity could use the remaining Pis/Cofins credit, resulting from the difference between the rate applied to the importation of the good and the rate applied to its resale in the domestic market, to request reimbursement, refund or compensation from the Revenue.
Bolsonaro also sanctioned, this Monday (5), a law that paves the way for the exemption of medical expertise from the INSS (National Social Security Institute) for the granting of benefits for temporary disability, replacing the procedure with the presentation of medical reports or certificates. .
On the other hand, the text also expands the list of “fine combs”, including accident assistance among the benefits that will undergo temporary reassessments to maintain the benefit. It also amends the legislation referring to the review of benefits to provide for the analysis of processes that show signs of irregularity.
Initially a provisional measure, the law had three vetoes by the Chief Executive, all of which concern changes in the asset management of the General Social Security Scheme Fund.
One of them provided that the Union would represent the fund in credits, duties and obligations, in the case of non-operational properties under the management of the Secretariat for Coordination and Governance of Union Heritage.
The second vetoed section, in turn, provided for the fund to bear the costs of conservation, evaluation and administration of the properties that constitute its real estate assets.
The last provision withdrawn by the Executive said that functional properties occupied or not that constitute the real estate of the Fund of the General Social Security Regime.
