Nursing floor suspension is just a break to find a source of funds, says Barroso

Minister Luis Roberto Barroso, of the STF (Federal Supreme Court), said this Thursday (8) that the decision to suspend the national salary floor for nursing was a pause with the aim of creating, in a consensual way, a source of funding. to enable compliance with the law.

“My position is that the establishment of a floor for nursing and other health professionals is very fair. Therefore, I am committed to making this floor possible”, said Barroso after the STF session this Thursday.

“My view and that of many is that, without building a source of funding, it would be very difficult to get this salary floor off paper. Therefore, my concern is not to allow a fair recognition to these health professionals, who were tireless during the pandemic, end up being a fiction.”

According to Barroso, when he ordered the suspension of the floor, there was a real and imminent risk of general non-compliance with the law.

“Many hospitals were already dismissing in anticipation because of the difficulty in meeting the floor. Important social works warned that they were going to close. The Santas Casas, if they managed not to close, would already be waving a reduction in service. , said the minister.

Last Tuesday (6), Barroso met with the president of the Senate, Rodrigo Pacheco (PSD-MG), to discuss the issue. The two met for about an hour in the minister’s office, who is the rapporteur in the Supreme Court of the action suspended the law. The meeting was closed.

In a note released after the meeting, the Supreme Court informed that the two defend the importance of the need for the floor, but “agreed on the need for a perennial source of resources to make salaries at a minimum level”.

“Three points were put as possibilities: the correction of the SUS table; the exemption of the sector’s payroll; and the compensation of the debt of the states with the Union”, says the note.

After the meeting, Pacheco said that the national level of nursing becomes an “absolute priority for Congress”, and that the correction of the SUS table -which depends on the Executive Branch- seems to be the “most viable path”. According to him, the table should “have been corrected a long time ago, considering the lag”.

Barroso also spoke with the president of the Chamber, Arthur Lira (PP-AL), by telephone, and with the rapporteurs of the measure in Congress.

Barroso’s decision will be analyzed in a virtual plenary session of the STF that begins this Friday (9).

The virtual trial, on a platform where ministers cast their votes, will last a week and may be interrupted if any member of the Supreme Court asks to analyze the case in the physical plenary.

It can also be interrupted in the case of a minister’s request for a view, which would paralyze the issue.

Barroso suspended on the 4th the national salary floor for nursing. The magistrate determined the suspension “until it is clarified” the financial impact of the measure for states and municipalities and for hospitals.

The norm set the minimum wage of R$ 4,750 for nurses. Nursing technicians should receive 70% of this amount, and nursing assistants and midwives, 50%.

Barroso gave 60 days for the federation entities, sector entities and the Ministries of Labor and Health to express themselves on the capacity for the floor to be met. “The precautionary measure will remain in force until the matter is reconsidered in the light of the clarifications provided”, he decided.
