The plan starts as a pilot in Attica. What will happen if it is found that an owner has not registered his pool.
Them undeclared pools its control mechanism is looking for Independent Public Revenue Authority. The new technologies are able to identify the swimming pools that exist throughout the territory, but as everything shows, the plan starts as a pilot in Attica. And this as it may not be easy to determine in the whole territory whether a pool is declared or not. In cases where it is found that an owner has not declared his swimming pool, on the one hand, the ENFIA will be recalculated as well as the income tax, as they are a presumption of living, while at the same time a luxury living tax is imposed. In addition to the above taxes that will be paid, and in fact with retroactive effect, fines will also be imposed.
As reported by Kathimerini, the services of the tax administration are currently planning the way in which the audit will be conducted and the means that will be used to identify them.
The process is complex, as sources from the Ministry of Finance state, and in order to reach their disclosure, aerial photos will be used through google maps, the declared data in E9 (swimming pools are declared in column 9, code 11), while in some areas data from the Land Registry can also be used. Although the Land Registry has not yet been connected to Taxis, the AADE services will request data electronically, which will be cross-referenced with the findings obtained from google maps.
The tax administration is essentially following the plan of the French authorities, who discovered more than 20,000 undeclared private pools and began to impose fines on their owners. The revenue that the fines have brought to the coffers of the French state amounts to around 10 million euros, according to French media. Data and statistics website Statista reports that there were more than 3.2 million private swimming pools in France in 2020, as sales of the type had increased dramatically before the coronavirus pandemic. But during the pandemic, and since many more people are working from home and looking for a better environment, sales have seen a further increase.
If the venture is crowned with success, the tax administration will expand checks not only on swimming pools owned by citizens throughout the territory, but also to uncover illegalities in real estate. For example, if there are pergolas or auxiliary spaces that have not been declared, even buildings which are illegal, i.e. without a building permit.
The interconnection of the Taxis system with the Land Registry is expected to create significant problems for property owners who have declared incorrect information on the E9 form (declaration of property information). But those who have never declared their properties in E9 and have avoided paying property taxes for years will have a bigger problem. The commander of AADE, G. Pitsilis, in an earlier statement, had emphasized that preparations have begun to link the database of AADE with the Land Registry. This means that checks and cross-examinations will be launched on both sides with the aim of identifying cases of tax evasion and correcting mistakes in the properties on the one hand.
Those who find differences will be sent new settlement notes, with which the additional ENFIA will be attributed to them, for all the years in which the immovable property they owned was greater than what they had declared in E9. And the tax will not only stay with ENFIA, it will also go back to EETIDE. With the interconnection of the electronic systems, the auditors of the AADE will gain direct access to the records of the National Land Registry and will immediately locate all immovable and real rights (full or small ownership, usufruct, etc.) that exist declared both in the areas outside the city plan, and which are not declared in form E9.
It is noted that the connection of Taxisnet with the Land Registry has been a prerequisite since January 2018 and is still pending. Now AADE auditors will be able to:
– To identify owners who have not declared their real estate in the E9 form in order to avoid paying ENFIA and other taxes. – To look for taxpayers with overdue debts to the tax office, which they leave unpaid and unregulated despite the fact that they have large real estate.
What does the interconnection plan of Ktimatologio S.A.’s systems provide for? and of AADE: – The interconnection of centralized computer systems and the exchange of data regarding the provision of mutual possibility of direct access to the data of the electronic files they maintain for the exchange of data and data of real estate, registrable rights and beneficiaries. – The exchange between the entities of the elements and the data they collect and keep, which can be achieved technically in two alternative ways, namely their mass storage and handling with digital means of transport and the use of online services.
