Injunction forces Caixa to fight sexual and moral harassment against employees

The Justice determined this Wednesday (26) that Caixa Econômica Federal adopt eight measures to combat episodes of sexual harassment, moral and discrimination against its employees.

Among other points, the bank is prohibited from persecuting employees who have filed a lawsuit and researching the political position of those seeking management positions.

The preliminary decision is by the judge Pedro Luís Vicentin Foltran, from the Regional Labor Court of the 10th Region. Caixa was contacted by the report, but has not yet responded.

The judge states that the witnesses’ testimony reveals inappropriate attitudes of superiors against employees such as touching the body, obscene comments, persecution, embarrassment, tantrums and cursing.

Foltran also highlights the significant increase in cases of moral and sexual harassment within the company. According to him, the data reveal “that the entity has not been adopting practical measures capable of effectively reducing or eliminating this type of illicit”.

He points out that, according to information sent by Caixa itself, 205 complaints of sexual harassment were registered during the administration of former president Pedro Guimarães, most of which ended up shelved.

“The specific increase in complaints in 2022 undoubtedly denotes the climate of inertia and impunity denounced by the Public Ministry of Labor”, says the judge.

According to the decision, Caixa must refrain from exposing its employees — whether those who work at the head office, in Brasília, or at the branches — to episodes of moral or sexual harassment and discrimination, guaranteeing them a healthy work environment.

The bank must also act within a maximum of 30 days when receiving reports of moral and sexual harassment, completing the process within a maximum of 90 days, in addition to offering psychological support to the victim and support for criminal representation against the harasser.

The judge determined a daily fine in the amount of R$ 10 thousand for each obligation not fulfilled. Guimarães’ defense was also sought, but did not manifest itself until the publication of this text.

The MPT (Prosecutor’s Office of Labor) demands in court the payment of compensation in the amount of R$ 300 million for the public company’s failure to investigate and punish cases of sexual and moral harassment.

The institution also wants former president Pedro Guimarães to be sentenced to pay R$30.5 million for the practices of sexual, moral and discrimination harassment.

The investigation conducted by the bank’s internal affairs department confirmed the information raised by the Public Ministry, according to reports made to the report. The conclusion was presented to Caixa’s Board of Directors and sent to the authorities.

On Monday, President Jair Bolsonaro (PL) relativized the allegations against the executive and said he saw “nothing blunt” in the victims’ reports. In response, the complainants said the statement was “appalling”.
