INSS takes 4 months to release sick pay and 2 months to grant retirement

The sick insured person who needs to be away from work waits, on average, 122 days — four months — to get sick pay from the INSS (Instituto Nacional do Seguro Social). In the case of retirement based on contribution time, the average waiting time, of 68 days, exceeds two months.

The data are in a report by the IDBP (Brazilian Institute of Social Security Law) based on numbers sent by the institute to the body this week. The extraction is based on the month of September.

The report also points out that the average wait time of 122 days applies to other disability benefits, including accident benefits and disability retirement.

Among the main reasons for the delay are failures in the insured’s registration and problems in the INSS’s administrative structure.

In a note, the institute states that it has invested in the development of new technologies to facilitate and expedite the requests of policyholders.

“The expansion of data crossing with other government databases has also contributed to a more effective assessment of citizens’ rights”, says the institute, which cites the bonus paid to medical experts and the opening of a public tender with a thousand vacancies as actions that can improve the flow of grants and decrease the queue.

In this month of October, the stock of orders was below 1 million for the first time in years, adding up to 976,000 policyholders on the waiting list for the concession. Of this total, 560,000 are awaiting sick pay, which began to be granted without expertise in some situations, only with documentary analysis, at the end of July this year.

The lawyer Adriane Bramante, president of the IBDP, says that, with the robotization of the INSS systems, the negatives have increased. Adriane defends the use of technology, but believes that adjustments must be made.

According to her, there is a meeting scheduled with the institute in November to discuss the reasons for the delay. The IBDP report also shows that, depending on the location and benefit, the wait may be longer, as is the case with the BPC (Benefit of Continued Provision) for the disabled, which takes more than 200 days to be granted.

For Roberto de Carvalho Santos, president of Ieprev (Institute of Social Security Studies), the failures in robotization indicate that artificial intelligence is acting against the citizen, which needs to be changed. “The INSS could only use the robot when the system was 100%”, he says.

In a note, the SINSSP (Social Security and Social Security Workers Union in the State of São Paulo) criticizes the way artificial intelligence has been used, calling the action of robots automatic dismissal. “The Bolsonaro government uses ‘artificial intelligence’, robots, to deny the benefits required by the population”, he says.

On the other hand, Fenasps, a federation that represents Social Security, assistance and health workers in the country, says that, today, there is a need to recompose at least 23,000 servers. The agency criticizes the implementation of “digital platforms that have drastically restricted service to the population” and states that there are flaws in internet access, in addition to the difficulty of some citizens in using the platforms.

The request for sickness benefit without face-to-face expertise can only be made through the Meu INSS app or website for diseases whose leave period is up to 90 days.

Assistance without expertise is not valid for benefits of an accidental nature, that is, linked to illness or work accident. Those who already have marked expertise can also opt for document analysis.

According to Francisco Eduardo Cardoso Alves, vice president ANPM (National Association of Expert Doctors), what delays the granting of aid in this modality is the lack of updating of the Cnis (National Register of Social Information).

In the case of those seeking retirement, the lawyers say that the first step is to have their Cnis up to date. It is necessary to verify that all periods of employment are included in the register, as well as the salary values.
