Justice releases BRL 1.54 billion to pay INSS arrears

The Federal Court released, this Monday (21), the payment of arrears from the INSS (National Institute of Social Security) for insured persons who won an action for revision or granting of benefit. To be contemplated in this lot, the payment must have been authorized by the Justice in October (stage called assessment).

The CJF (Federal Justice Council) transferred BRL 1.877 billion to pay RPVs (Small Value Requisitions), which are in arrears of up to BRL 72,720. The lot will settle 142,817 processes to 174,922 beneficiaries.

For social security and assistance processes —such as requests for revision and granting of pensions, sickness allowances, death pensions and other benefits—, R$ 1.54 billion will be allocated. According to the CJF, 101,238 beneficiaries will receive amounts from lawsuits linked to welfare or INSS benefits.

The date of release of the money in a Caixa or Banco do Brasil account depends on the schedule of each court where the action was analyzed. At the TRF-3 (Federal Regional Court of the 3rd Region), which serves policyholders in São Paulo and Mato Grosso do Sul, the money is usually released within a week.

WHO HAS THE RIGHT?

Insured persons who sued the INSS and won the action, and whose date of the judge’s payment order is October of 2022. The process must be up to 60 minimum wages.

The RPVs to be paid refer to the concession or revision of:

• Retirement
• death benefit
• sick pay
• BPC (Continued Provision Benefit)

Step by step on TRF-3:

1. Go to “Procedural consultation”, on the right side of the screen, in a green frame
2. Click on the little arrow next to “Process number” and choose the option “Payment requests”
3. Then, go to “Queries by OAB, Process of origin, Requisitor Office of origin or Protocol number”
4. Enter your CPF, OAB of the lawyer or the case number and click on “I’m not a robot”
5. Then go to “Search”; your RPV will then appear
