The start of a new era in terms of real estate transfers is ushered in by the joint decision signed by Theodoros Skylakakis, Apostolos Vesyropoulos, Kostas Hatzidakis, Kostas Skrekas, Nikolaos Tagaras, Theodoros Livanios, Kyriakos Pierrakakis and George Pitsilis.
An era in which bureaucracy, inconvenience, loss of valuable time and the burden on taxpayers’ mental health are a thing of the past.
Real estate transfers are entering the era of the electronic file for each property, which with the joint ministerial decision entered pilot mode and will be fully operational from November 1, 2023.
The electronic file simplifies a until a few days ago complex process as it digitizes the process of collecting the supporting documents required for the drafting of the notarial documents.
It is sufficient that the contracts are concluded exclusively between natural persons on real rights in properties that have been registered and located in areas operated by a Land Registry Office.
The electronic file of the property contains the following certificates which can be obtained at any time from the notaries:
- Title deed (contract or copy of title deed)
- ENFIA certificate
- Proof of awareness
- Proof of insurance awareness
- Municipality certificate of non-debt TAP
- Certificate of Completion of Building Identity/ Divided Ownership
- Any declaration of compliance with Law 4178/2013 or Law 4495/2017 and proof of payment of the relevant fine as defined in the above laws.
- Engineer’s plans.
- Energy efficiency certificate.
- Topographical diagram and building permit data/drawings (executive, coverage diagram, floor plans, topographical)
- Excerpt of Cadastre Chart
So with 5 electronic processes and a few clicks, the transfer of the property will be completed in a very short time:
THE PLATFORM: The “Electronic Real Estate File” “runs” on the digital portal of the Government gov.gr. Users of the platform are the notary who draws up the notarial deed and the contracting parties (buyers and sellers). The notaries, after being authenticated with the codes of the notary register, enter the platform using their personal codes on taxisnet (with the same codes they enter and the parties.
PROPERTY TRANSFER REQUEST: The notary creates a new transfer application by entering the VAT numbers of the contracting parties. Then, it invites the seller and the buyer through the platform, to accept the transfer request and give the necessary authorizations so that the notary can draw the necessary documents. The electronic file of the transfer is thus created.
In the third stage, the necessary certificates are collected. The tax awareness, proof of insurance awareness and proof of payment of capital transfer taxes are now merged into a single Certificate.
