Clarifications for maternity allowance to salaried lawyers insured in e-EFKA

With a circular of the Deputy Minister of Labor and Social Affairs, Panos Tsakloglou, clarifications are given regarding the granting of pregnancy and maternity allowance for salaried lawyers, solving a chronic problem of insured women, as pointed out in a statement by the Ministry of Labor and Social Affairs.

Specifically, clarifications are provided on article 83 of law 4826/2021, which explicitly established the provision of pregnancy and maternity benefits to salaried lawyers in proportion to what applies to employees insured, based on article 32 of law 4387/2016 . The purpose of the circular is to provide clarifications to e-EFKA questions regarding the conditions for granting the allowance to salaried lawyers insured in e-EFKA and instructions for the effective development of the relevant software by the institution.

According to the circular, the hired lawyer who belongs to the former Ε.Τ.Α.Α.-Τ.Α.Ν. is entitled to a pregnancy and maternity allowance for 119 days (17 weeks), of which 56 days (8 weeks) before childbirth and 63 days (9 weeks) after it. The condition for granting the allowance is that the salaried lawyer has completed at least 200 days of insurance during the last two years preceding the day of delivery. 120 of the 200 days of insurance must have been spent as a salaried lawyer.

In addition, it is noted that the granting of the allowance is not affected, if the salaried lawyer exercises the free profession at the same time with an active KAD.

At the same time, it is clarified that the possibility of exercising the right to pregnancy and maternity allowance applies not only for the future (from the enactment of law 4826/2021 onwards), but also for births that took place from 01/01/2017 onwards. Especially for them, the application for the grant of the allowance can be submitted from 07/09/2021 (voting of no. 83 of law 4826/2021) and up to 8 months later (07/05/2022).
