The CJF (Council of Federal Justice) announced this Friday (21) that it has released the monthly batch of arrears from the INSS (National Social Security Institute) to 63,700 beneficiaries who have won lawsuits for granting or reviewing pensions, pensions and other benefits.
In total, R$960 million in arrears were paid to the federal regional courts. According to the council, 50,518 processes will be covered.
The money will be used to pay RPVs (Small Value Requisitions) that were authorized by the Court in December. To be entitled to an RPV, the lawsuit must have been completed, with the payment defined by the Justice, and with arrears of a maximum of 60 minimum wages (which corresponds to R$ 66 thousand in 2021).
The schedule for releasing the amounts into a bank account at Banco do Brasil or Caixa depends on each court. The TRF-3 (Federal Regional Court of the 3rd Region), which serves São Paulo and Mato Grosso do Sul, reported that it has already started processing the information and the procedure for releasing the money to beneficiaries must be completed within seven days. In the region, R$ 167.7 million will be paid in RPVs.
According to the TRF-1 (Federal Regional Court of the 1st Region), payments in the region of its jurisdiction must take place at the end of January. The court is responsible for cases in the Federal District, Minas Gerais, Goiás, Mato Grosso, Bahia, PiauÃ, Maranhão and the entire North region (Acre, Amapá, Amazonas, Pará, Rondônia, Roraima and Tocantins). The RPVs receivable can be consulted through the CPF and process data on the TRF1 website.
The TRF-2, which serves Rio de Janeiro and EspÃrito Santo, informed that the money from arrears must be deposited in February and be available for withdrawal from the fifth business day of March.
According to the TRF-4 (Federal Regional Court of the 4th Region), responsible for the states of Rio Grande do Sul, Paraná and Santa Catarina, the forecast is that the values ​​will be available from February 3.
In the states of Pernambuco, Ceará, Alagoas, Sergipe, Rio Grande do Norte and ParaÃba, served by the TRF-5 (Regional Federal Court of the 5th Region), payment must be made available from February 8, according to the court. The movement of the process can be consulted in the area of ​​the TRF-5 website. The RPVs will be paid exclusively by Caixa Econômica Federal, and the beneficiaries must go to an agency with an identification document, CPF and proof of residence.
As the current batch includes arrears assessed in December, it will be the last with the amount of up to BRL 66,000, since RPVs assessed from January onwards will consider the 2022 minimum wage of BRL 1,212. In other words, the new limit to receive via RPV, which comes out faster, will be R$ 72,720 in the next release.
Also starting this month, RPVs will be corrected by the Selic rate, as established by the PEC dos Precatórios (Proposal for Constitutional Amendment 113), according to the TRF-3.
Delayed benefits, guaranteed by the Court, range from retirement reviews to sickness benefits, pensions and other rights.
The total amount released by the CFJ in December amounts to R$ 1.18 billion, but this amount also includes other RPVs, which are not related to social security and assistance benefits.
To find out if your arrears were included in this batch of payments, the insured can consult their lawyer or enter the website of the court responsible for the action. There, it will be necessary to confirm if the arrears generated is an RPV and if the month of December appears on the date of assessment of the arrears.
Those who won a lawsuit with amounts above 60 minimum wages are entitled to a precatory, and not RPV, which has another rule for releasing the payment.
