The operation of the Register of Trade Unions of Employees and Employers starts tomorrow, Tuesday, February 1, 2022, within the framework established by the Law on Labor Protection 4808/2021, as specified by decision of the Minister of Labor and Social Affairs, 16 Kostis Hatzis -2021, Government Gazette BD4279).
This is a measure that enhances the transparency of trade unions, as the data that will be registered in the Register will clearly show which union represents whom and where unions are identified – “seals”.
The operation of the Register is an innovation compared to the past, as the submission of the required data and files will be done exclusively digitally and with the initiative and responsibility of the trade unions themselves. After their initial registration, the organizations have the sole responsibility of keeping the files and data in their digital portion.
The Register is kept in electronic form as a database in the PS. ERGANI, is accessible at the email address mitroaorganoseon.yeka.gov.gr and consists of the following sub-Registers: a) General Register of Employees ‘Trade Unions (GE.MISOE) and b) General Register of Employers’ Organizations (GE) . ΜΗ.Ο.Ε.).
From 1 February, it becomes technically possible to register in the Register of organizations for which the relevant obligation is provided, ie for all trade unions of workers, associations of workers and employers’ organizations and especially those that conclude collective agreements or appoint their representatives in administrations of the bodies supervised by the Ministry of Labor and Social Affairs, as well as its collective bodies. It is reminded that, according to Law 4808/2021, the registration in the register is a condition for collective bargaining, declaration of strike and signing of a Collective Bargaining Agreement.
For the registration of the obligated organizations of employees and employers in the relevant register (GEMISOE or GEMHOE) it is required, as the case may be, the submission of the following files and / or data:

Elements of Articles of Association (Constituent / Constituent Act, Certified Articles of Association, Registration Order, Court for filing an application for registration, Number-Year-Court of registration)
After their registration in the Register, the organizations are given the opportunity to export a standardized Registration Certificate with a unique serial number imprinted on its body through PS ERGANI II which can be used for any legal use.
The maritime organizations as well as the organizations of articles 30A (police officers), 30B (civilian personnel EYP) and 30C (military and corps) of law 1264/1982, as in force, are excluded from the obligation to register. It is also recalled that especially the trade unions of employees (and not employers), which are recommended from 01/01/2022 onwards (recommended), acquire legal personality by registering with GEMISOE and submitting to it all the information required by law.
It is recalled that the services of the Ministry of Labor and Social Affairs can access the contents of the Register in order to fulfill obligations arising from the legislation, such as, for example, during the process of establishing that collective labor arrangements are already binding employers, who employ more than 50% of employees in the industry or profession. In any case, the legislation on the protection of personal data applies.
