The EFKA liquidation of shame: Why pensions of €0.30 and €0.60 are paid
By Vangelis Dourakis
Unthinkable: And yet, in the Greece of 2024, there are people who are out of work to whom the State pays a “tip” of 30 cents as a pension amount to make it through the month. And these “crumbs” are collected by the particular pensioners for months and in some cases for years. exclusively brings to light the settlement notes issued by EFKA and which, as you can see, show as payable the amount of €0.30 in one case and €0.60 in the other!
Naturally, these cases raise questions: What happened and the particular pensioners receive a few cents of the euro as a pension?
Who receives pensions of €0.30 !!!
What must be made clear from the outset is that these are cases of civil servants who used fictitious years to establish their pension rights.
The retirement decisions were issued together with the notional time redemption decisions.
As is logical, part of the amount corresponding to the redemption of the fictitious years should be withheld from the pensions.
But somewhere here… the logic stops: Instead of deducting an amount that does not exceed 25% of the total pension benefit from the pensions paid, the General Accounting Office of the State does NOT apply the relevant circular of Panos Tsakloglou and withholds almost the entire amount for the repayment of fictitious.
On the contrary, all other entities in cases of purchase of virtual time withhold the maximum 25% of the pension’s earnings.
As the labor expert Dionysis Rizos explains to skai.gr, the responsible officials of the GLK claim that they are forced to apply the previous legislation Legislation of the Code of Civil and Military Servants of PD 169 of 2007, as the EFKA’s digital system does not … “recognize” another variable .
In addition, the temporary pensions received by the specific retirees are considered “unduly” paid and are sought as a debt!
As a result, many unemployed people receive pension amounts between €0.30 and €0.60!!!!
What does the Tsakloglou circular state?
But what does the Tsakloglou circular state, according to which any withholding should not exceed 25% of the total pension benefit?
“II. Payment in installments
In the case of repayment in installments, the relevant redemption amount is paid in as many monthly installments as there are recognized months.
The first installment is paid by the end of the month following the notification of the recognition decision.
Delay in payment of an installment entails its being burdened with the respective prescribed interest for delay.
In the case of establishing a pension right or submitting a request for retirement where the recognized insurance time is used to increase the amount of the pension, before the redemption contribution is paid, an amount equal to 1/4 is withheld every month from the pension until the debt is paid of the pension.
G. Recognition of insurance time in the supplementary insurance branch of e-EFKA
The above applies respectively to the recognition of insurance periods in the supplementary insurance branch of the e-EFKA in accordance with par. 2 of article 96 of Law 4387/2016 as replaced and in force by Article 44 of Law 4670/2020 and the par. 1c of Article 40 of Law 4052/2012, as replaced by Article 79 of Law 4387/2016 and Article 42 of Law 4670/2020.
It should be noted that, in accordance with the above-mentioned provisions, in the case of the establishment of a right to a supplementary pension with recognition following the redemption of years of insurance, the due redemption amount, as long as it does not exceed the amount of three thousand (3,000) euros, is set off or withheld from all the beneficiaries supplementary pension amounts.
As long as the due redemption amount exceeds three thousand (3,000) euros, the part that exceeds three thousand (3,000) euros is paid in one lump sum before the retirement decision is issued, while the remaining part is set off or withheld from the total amount of supplementary benefits pension (related or under no. Φ80020/12293/D16.317/3.4.2020 circular, AD: ΣΓ8Α46MTLK-ANS)’.
