Following the publication of the summary of his decision State Council with which it is considered unconstitutional, a series of NOK provisions, the Mayor of Kifissia issued a new “Edited”, to the Yomo for the purpose of controlling and fully implementing the plenary decision. In particular:

What is going to be done with existing building permits:

On the provisions deemed unconstitutional The Municipality of Kifissia is temporarily interrupted by all the building permits, which have been issued but not completed.

Interested parties should, in order to receive a Certificate of Continuing on the continuation of the work, prove the stage at which the building is located. Continuation will be given if at least the execution of excavations proves before 11/12/2024, in compliance with the decision and instructions of the Council of State.

What is going to be done with underground extensions:

Concerning the extensions of the basements, in addition to the outline of the building, which continues to pending in the CoE, the Municipality of Kifissia, to protect the city’s identity and rescue natural wealth, follows the same direction and continues to not issue building permits, using Article 17 (6b) of the new building regulation (NOK, 4067/2012), as the question of the constitutionality of Article 17 (6B) is pending before the Council of State after the adoption of no. 662/2023 Decision of the Fifth Section.

It is noted that in cases where the building permit was issued by the TEE pursuant to Article 17 (6B) of the NOK, after 4/10/2024, that is, in breach of the mayor’s order for non -issuance of building permits on the basis of the provision. Article 17 NOK, will not be permitted to commence or continue any work.
