Women who have already completed or will reach the age of 61 years and six months by the end of 2022 are entitled to an INSS (National Social Security Institute) old-age pension if they have at least 15 years of social security contributions.
This is the last year in which the insured will have access to the benefit below the minimum age that will be valid from 2023. Next year, according to the rules of the Social Security reform, workers will only have retirement by age from 62 years old.
Pension rules changed in November 2019, with the publication of constitutional amendment 103. Before the reform, women retired at age 60 and had 15 years of contributions to the INSS.
With the change, the minimum age of 62 was implemented for new insureds, but those who were already in the job market are entitled to the transition rule. The minimum age has increased by six months each year.
The transition rule for women’s old-age pension comes to an end this year. For men, the reform did not change the minimum age and they continue to retire at age 65, if they have contributed to Social Security for 15 years.
Another change brought about by constitutional amendment 103 was in the calculation of the benefit, which is among the ones that changed the most. There were two significant changes: in the average salary and in the final value of retirement.
Before the reform, the average salary was calculated taking into account the 80% of the highest salaries of the insured person from July 1994 to the date of retirement. On this average, a percentage was applied according to the type of benefit.
In retirement by age, the percentage applied was 70% plus 1% for each year of contribution. As everyone had to have 15 years of payments to the INSS, retirement was calculated with a minimum of 85% of the insured person’s average. After 30 years of INSS, women and men retired with full benefit, that is, they received 100% of their average salary.
How was the new calculation of the old-age pension after retirement
Now, after the reform, the calculation was different. There was a change in the way in which the average salary is calculated and also in the percentage paid in retirement to the insured. To calculate the average salary today, all workers’ salaries are taken into account, that is, the lowest 20% also enter the account, reducing the average on which retirement will be calculated.
The minimum percentage of 60% plus 2% is applied to this average salary for each year that exceeds 15 years, for women. In the case of men, the extra percentage is applied after 20 years of payments to the INSS.
As a result, women, who previously retired at 60 years of age with at least 85% of their average salary, today, if they have only 15 years of INSS, will retire with 60% of their average salary. An insured person with an average salary of BRL 2,000, for example, would receive BRL 1,700 in retirement before retirement. Today, with the same average salary, he will receive the minimum wage of R$ 1,212.

How to simulate the benefit amount and place the order
Insured people who are going to retire can simulate the benefit amount through the Meu INSS app or website. You must have a password, which can be generated on the spot. In addition, to access, it is necessary to inform the CPF. On the My INSS website, on the home page, go to “Simulate retirement”, on the right side of the screen.
The rules in which the insured person fits and the value of the benefit will appear. If there is any difference in what she expected to receive, the worker must gather all the documents she has with her to apply. If the INSS has recorded wrong values, the documentation will correct the failure.
Those who made the simulation can go to the button at the bottom of the page and click on “Request retirement”. In the case of those who are entering the application or website, on the home page, go to “New order” and choose “Retirement and CTC and Savings”. Then click on “Urban Age Retirement”. Enter the data and follow the step by step. At the end, photograph or print the protocol and close the request.
The request can be tracked through the My INSS app or website. The necessary documentation can also be sent online. Those who prefer can make the request by calling 135, which is open from Monday to Saturday, from 7 am to 10 pm.
See who is entitled to the benefit
Anyone who can prove that they have completed the conditions to retire by age with the rules prior to the pension reform can still apply and have the most advantageous calculation.
Another differential of the pre-retirement age pension is that the average salary will be calculated with the withdrawal of the lowest 20% of contributions since July 1994. This discard is no longer valid for those who retire with the rules after the retirement.
For those who have the so-called acquired right, the arrears start to count from the date on which the request for retirement is registered with the INSS.
Housewives and MEIs also have old-age pensions
Retirement by age is also the benefit to be granted to those who contribute to the INSS as MEI (Individual Microentrepreneur), as self-employed, with a contribution rate of 11%, and for low-income housewives, who contribute 5% of the minimum wage.
In these three cases, retirement will be granted in the amount of the minimum wage (R$ 1,212 in 2022). The insured person who obtains retirement by age is on the list of those entitled to the 13th of the INSS.
