Presenter Sikêra Jr., 55, has entered into an agreement with the Public Ministry of Amazonas and will now have to pay, according to his lawyer, R$ 2,000 to a charity institution in the process that involves offenses to the presenter Xuxa, 59. criminal action whose settlement was accepted in order to get rid of a possible criminal conviction.
According to lawyer Rannieri Cavalcanti Lopes, this phase of the process is called a criminal transaction and is a prerogative that the MP has to try to close a process of lesser offensive power. Xuxa filed a lawsuit for an alleged attack on honor by accusing the presenter of offenses on his program. She also didn’t like the exhibition of a zoophilia scene in the RedeTV! attraction.
“Given the wear and tear that could occur from responding to a lawsuit while being innocent, since Sikêra has an unblemished reputation, as a lawyer I thought it was good to accept the MP’s proposal”, he says, who explains that a criminal transaction “is not a confession of guilt and does not generate a criminal record”.
This stage of the criminal procedure has nothing to do with the civil stage. In March, Sikêra was ordered to pay R$300,000 to Xuxa for moral damages, as reported by the São Paulo Court of Justice. Judge Ana Cristina Ribeiro Bonchristiano, from the 3rd Civil Court of Osasco, upheld the presenter’s request and also criticized the existence of programs such as the National Alert, led by Sikêra. Xuxa’s legal counsel, in a note, says that “it was clear that Sikêra Jr. would be sentenced at the end of the process and he then chose to make a direct agreement with the Public Ministry”. Xuxa’s defense will ask that any amount he may have to pay as a result of this process be reversed in favor of institutions that care for animals.
And he also reiterates that “the agreement does not free him from the conviction in the civil sphere, of paying the R$ 300 thousand to the presenter”. The presenter’s lawyers also say in the note that Sikêra will no longer be able to make use of an agreement like this one for a criminal transaction for the next few years.
