Amber Heard asked a Virginia judge to throw out the judgment she lost in her ex-husband’s defamation lawsuit Johnny Deppclaiming that the evidence and claims are not true, according to a report by the New York Post.
Heard’s lawyerswho was found guilty of three counts of defamation brought by the famous actor, claimed – in a 43-page petition filed last week – that the decision was not supported by the evidence during the former couple’s high-profile trial.
The filing states that Depp “proceeded solely on a … theory of defamation by implication, abandoning any claim that Ms. Heard’s statements were actually false,” the documents filed Friday allege.
Heard’s lawyers also argue that Mr “juror 15” of the panel may even have been illegally selected by giving the wrong date of birth during jury selection.
Depp, 58, sued his ex-wife, claiming she damaged his career with her now-famous 2018 op-ed in The Washington Post, in which she claimed she was a victim of domestic abuse and left no doubt that the report was about the star of movies “Pirates of the Caribbean”.
Depp’s lawyer noted that Heard’s testimony was “what we expected, just longer and more substantial.” In last month’s verdict, jurors awarded Depp $10 million in compensatory damages and $5 million in punitive damages, although Virginia law capped the total at $10.3 million.
Heard, 36, who countersued, won $2 million for one of her claims. However, the actress’ legal team argued in the new court filing that Depp failed to prove that his career and reputation were affected by the Amber Heard article.
“Mr. Depp has not presented any evidence of any property damage suffered in the limited time period from December 18, 2018 to November 2, 2020.” referred to in the sentence. “There was no evidence of any project or missed commercial opportunities».
The lawyers noted that Depp had not signed a contract for the Pirates of the Caribbean sequel, despite claiming in the lawsuit that the Washington Post cost him the role. The documents also claim that Depp has failed to deny the allegations of abuse.
