Ann Hess she only had $400,000 in her account, her son says. Ann Hess’ ex-partner James Tupper is now certain to lose his legal battle over the late actress’ estate.

Atlas, Hess’s youngest son, attended Tuesday’s court hearing with his father, but Tupper’s request to be appointed a guardian was denied by a Los Angeles Superior Court judge.

Tupper, 57, shook his head as he stood in court, wearing blue trousers and shoved his hands in his pockets, after learning the verdict.

Judge Bogdanoff, however, was disturbed by his gesture and yelled at him: “Don’t shake your head at me and take your hands out of your pockets!”

“I don’t think Atlas’ older brother, Homer, is going to look out for his best interests,” Tupper told the judge. “He treats him like an enemy. Their relationship will be ruined forever.”

According to court documents revealed by the Daily Mail, Hess’s net worth is just $400,000. Homer claimed that his mother did not own a home and lived in an apartment.
