The defense of Simone Regina, the woman run over in March by actor Lima Duarte, 93, says she will file a request for the actor’s arrest later this week because he had an expired driver’s license on the day of the accident. A search on the DMV website attests that the Globo veteran’s national driver’s license had expired on February 18 of this year. The hit-and-run in the Barra Funda region took place on March 1.
When contacted, Monica Maluf, one of Lima’s daughters, told the F5 that the period encompasses the legal 30-day period for renewal. The Detran-SP confirms this information. Lima Duarte’s new driver’s license was issued on April 19th.
Regarding the arrest warrant, which the victim’s lawyer, Ângelo Carbone, says he will file with the Public Prosecutor’s Office “between today and tomorrow”, Mônica says: “Lima will speak out soon, through his lawyers, but the heart of the family it bleeds and makes us wonder how nasty it can get”.
Carbone claims that on the day of the incident no breathalyzer test was carried out in Lima. In the case file, to which the F5 had access, the victim says that he could have ingested alcohol or some medication and that the artist would only have provided help more than an hour and a half later.
The 37-year-old woman, who works with motorcycle deliveries, signed a receipt weeks later in which she agreed to receive R$30,000 from the actor, but, according to Ângelo, she only did so under the influence of medication. Now, she asks for compensation of more than R$ 1 million and R$ 5,000 monthly until she can go back to work. The lawyer claims that she would have had several surgeries after breaking her hip, five bones and that she had screws in her leg.
“The actor had an expired license and nobody did anything. If he also drank, it would be a case of framing it in a malicious attempt, when there is an intention to put the person at risk. The procedure would be to take him to the police station, make it known that the CNH it was expired, take an alcohol test, maybe arrest the driver’s license, expertise, etc.”, comments the victim’s lawyer.
At the time of the accident, Lima Duarte even wrote a statement. “My priority was to ensure that the motorcyclist received the necessary assistance and that the situation was treated as seriously as possible. I would like to emphasize that I am a conscientious and responsible driver. After the collision, I immediately provided the necessary assistance and waited for the police,” he said.
