After the 9th Special Criminal Court of Rio de Janeiro accepted the complaint from the Public Prosecutor’s Office and opened proceedings against presenter Bruno de Luca for failing to help actor Kayky Brito when he was run over on September 2nd, his lawyer spoke out.
According to Rodrigo Brocchi, “Bruno de Luca did not commit the crime of failing to provide assistance.” In response to the report’s request, he states that there is no possibility of this type of crime if anyone close to the accident provides assistance to the victim.
“Bruno was not the cause of the accident, he has a specific obligation to provide assistance, as he in fact did, nor does he perform any function that brings him the legal obligation to provide assistance”, he says. “If that were the case, everyone present who was not the person to call the fire department would have failed to provide assistance”, he adds.
O F5 had access to the indictment document. Now, the Court must call witnesses and subpoena Bruno de Luca’s defense so that he can defend himself and prove that he did not know that it was Kayky who had been run over, as he claimed in interviews and statements.
In its investigation, the Rio Civil Police had not indicted Bruno de Luca. In the images of the accident, Luca appears with Kayky, but leaves without helping him even though he witnessed the accident.
“De Luca was the only one who would have left the scene immediately after the collision, without taking any action to provide assistance, nor even knowing that any assistance or request had been made”, states the text from the Public Ministry.
