Actress Tata Werneck won another battle in the lawsuit filed by RedeTV! against the comedian. The 5th Chamber of Private Law of the TJ-RJ (Court of Justice of Rio de Janeiro) dismissed the appeal filed by the Osasco broadcaster as unfounded, and won the case in the second instance.
According to a document obtained by F5 in a trial held this Tuesday (23), the Court denied the aggravation brought by RedeTV! due to a new joke made against TV by Amilcare Dallevo and Marcelo de Carvalho at the 2023 Multishow Awards, last November, broadcast by Globo.
In 2021, in the joke that caused the lawsuit, Tata Werneck said that her dress cost the price of RedeTV!’s programming. Last year, Tata again joked about the case, even though she had already been prosecuted.
“Two years ago I made a joke saying that my dress had the same value as the RedeTV schedule! and I was sued. I want to apologize and say that this year I came with a dress more expensive than the schedule for us not have this problem,” he said.
RedeTV! claimed that Tata’s new action proved her disrespect towards the broadcaster. Lawyer Ricardo Brajterman, who defends Werneck, stated that it was inconsistent for the TV that presented Pânico na TV (2003-2012) to want to censor comedians.
The court agreed with Tata and his lawyer’s argument, and ruled that the action was unfounded. RedeTV! You can still appeal the decision at higher levels, such as the STJ (Superior Court of Justice).
When contacted, lawyer Ricardo Brajterman celebrated his client’s victory and explained that there is no defamatory campaign against the broadcaster by Tata Werneck.
“I’m very happy with this victory. To this day I still can’t understand why Rede TV!, which has always made a lot of money from Pânico jokes and the horror show of loyalty tests, turned to the judiciary because of harmless jokes and without any defamatory nature. Freedom of expression, artistic freedom won”, he said.
“If the owner of the station himself announces that he can only pay the bills because he sells space for religious programs, it won’t be a joke from Tata that will alienate investors and commercial partners”, concluded the lawyer.
