Maíra Cardi is ordered to compensate follower for course with false advertising

Maíra Cardi was ordered to pay compensation to the follower who bought her online course, which promised daily income of R$250 and a partnership with the influencer. The São Paulo Court of Justice considered that the service offered “misleading advertising”.

In the first instance, the judge had decided that Maíra and the company Cura Você Consultoria LTDA should only return the cost of the course, R$829. The 10th Chamber of Private Law of the Court of Justice of São Paulo decided that the influencer must pay R$5,000 in compensation for moral damages to the author of the case.

According to the records, the “student” justifies the process by stating that “she did not receive the earnings promised by the influencer”. Thiago Nigro’s wife, Primo Rico, promised that the follower would work as her affiliate (“practically a partnership”) and that there would be individual advertising for each consumer, helping them to promote the products.

The decision says that “the promised partnership was unduly linked to the acquisition of another product.” “There was advertising with a strong appeal, which has the power to mislead consumers into believing that, upon purchasing and completing the courses, they would be ‘partners’ of the defendant”, he adds.
