Living on provisional release in Spain after being convicted of rape, Daniel Alves was ordered by the São Paulo Court to compensate two musicians with R$80,000.
According to documents obtained by F5, Giuliano and Thiago Abramo Silva demand compensation for moral damage from the former player. In the action, they claim that they were not included as co-authors of the song “Avião”, released by him in 2020, in a United Nations campaign.
The musicians claim that they presented the song to Alves in April 2017 and that, at the time, he suggested changes to four verses. In 2020, an advisor to the player reportedly contacted the duo to record the song, but, due to differences, the project did not proceed.
The authors claim that they were surprised when they saw a call on television announcing the release of the song’s music video, in November of the same year.
In the documents, Alves’ defense states that “Avião” was conceived by him in 2015 and that he was the one who shared the idea with Giuliano, who suggested changes to the lyrics that were not accepted by the former player.
Magistrate Priscilla Miwa Kumode also describes that the version recorded by Thiago on his cell phone in 2017 is practically identical to the one presented by Alves in a message sent to a music producer in 2019, and that he presented the song as if it were his creation.
“I consider partially valid the requests to: declare that Wanderlei José da Silva (Giuliano) and Thiago Abramo Silva are co-authors of the musical work ‘Avião’; sentence the defendant Daniel Alves da Silva to pay R$40,000.00 (forty thousand reais) to title of compensation for moral damages to each of the authors, with monetary adjustment by the IPCA from the date of delivery of the sentence and plus interest.”
There is an appeal. When contacted by F5, the former player’s press office did not respond. The judge also sentences Alves to pay the full costs, procedural expenses and honorarium of Thiago and Giuliano.
