Presenter Sikêra Jr., 55, and Rede TV! were ordered to pay BRL 300,000 as compensation to singer and model Xuxa Meneghel, 58, for moral damages. The decision was given this Thursday (24) in the first instance and is still subject to appeal.
Judge Ana Cristina Ribeiro Bonchristiano, from the 3rd Civil Court of Osasco, in São Paulo, upheld the presenter’s request and also criticized the existence of programs such as the National Alert, led by Sikêra.
“The criticism of this type of journalism stands out, as it discredits the person to the detriment of the argumentative analysis of their ideas, in programs that are much more entertainment than informative, camouflaging disproportionate offenses in the jocular narrative”, began the magistrate
“The presenters of these programs, with the blessing and encouragement of their companies, as now [Rede TV!]they do everything, without the slightest criterion, including airing death threats against public, honest and hardworking people, despising the private life and family of these people, just to leverage the audience of their television programs”, continued Bonchristiano.
The judge also stated that the presenters “put themselves above good and evil and, without reflecting or pondering what they say and the consequences of their actions, are always ready to attack, with their fierce tongues, the honest citizen and the dishonest, putting everyone on the same level, without the slightest respect for human honor and dignity”.
Initially, Xuxa had requested compensation of BRL 500,000, but the judge determined that the payment was BRL 300,000. In addition, the presenter and the broadcaster will have to pay for the costs of the process, equivalent to about 20% of the indemnity value, approximately R$ 60 thousand.
“As for the amount of compensation for moral damages, in line with the best doctrine and prevailing jurisprudence, it is to be determined taking into account the economic standard of the victim [Xuxa]to alleviate his suffering, providing him with some material comfort, and that of the debtor [Sikêra Jr. e Rede TV!], so as not to lead him to ruin. Conviction, in kind, has an educational character of discouraging recidivism.”
UNDERSTAND THE CASE
In November 2020, Xuxa expressed her opinion about the presenter of Alerta Nacional (Rede TV!), through her column on the website of Vogue Brasil magazine. In the publication, made on October 28 of that year, Xuxa stated that she intended to sue Sikêra due to the exhibition of a zoophilia scene on her program.
After a few weeks, Notícias da TV reported this Monday (16) that the presenter’s request was registered at the Civil Court of the Regional Forum of Santo Amaro, in São Paulo, on October 27. In the action, she asks the presenter for compensation of R$ 500 thousand – and says that the money will be donated to animal cause institutions –, the suspension of her MTB (professional journalist registration) and that the National Alert be taken off the air, under the penalty of a daily fine of R$ 20 thousand for each episode that comes to be shown.
To the F5, Xuxa’s adviser declined to comment and give details about the process, but reinforced the presenter’s fight against zoophilia (sexual practice with animals), which is considered a crime in the country. “It seems that he wants to be very popular and cartoonish, a mixture of clown and reporter with a very forced, awkward and crude posture. In the image I saw he was laughing, mocking a crime, zoophilia. Instead of the presenter saying how wrong this is, he asks someone from his team to wear an animal mask and someone else does the rape scene. All this below a lot of laughter”, said Xuxa in her text for Vogue.
