ΣτΕ: The new special salary of NSS is unconstitutional – It will not have retroactive effect

The consequences of the decision of the Council of State will take effect from the publication of the decision.

It was deemed unconstitutional, by decision of the Plenary Session of the Council of State, the special salary list of NSS doctors which was voted in 2017. Based on the decision of the Supreme Court, the doctors that the NSS who had appealed and won the lawsuit will not receive retroactively from 2017 when the payroll that was now canceled was valid.

The consequences of the decision of the Council of State will take effect from the publication of the decision.

The Plenary Session was chaired by the Honorary President of the Supreme Court, Irene Sharp, and the decision is numbered 1408 of 2022.

In particular, doctors of the National Health Service had appealed to the SC. against their payroll statements and by the State advisers their applications were accepted in the part that was directed against the salary statements of the month of July 2018, while on the contrary it was rejected in the part that was directed against the tacit rejection by the hospital in which they serve, of their request for revocation of their previous salary statements and re-issue of their salaries, based on the provisions in force before Law 4093/2012.
