On the issue of the constitutionality of the measure of compulsory vaccinations for those over 60, announced by the Prime Minister at noon, the emeritus professor of Constitutional Law, Antonis Manitakis, was placed on SKAI 100.3.
Mr. Antonis Manitakis pointed out that there is no question of unconstitutionality of the measure of compulsory vaccinations for those over 60 years. He referred to relevant case law of the CoC on categories of workers who have been vaccinated, but also in most European courts, including the European Court of Human Rights.
As the professor characteristically said, “their freedom is not affected, especially when it comes to saving dozens of human lives a day in this way.” If no measures are taken, he stressed, a large percentage of people of this age will continue to be lost. It is therefore justified to infringe on another good when human lives are to be saved in order to increase the rate of immunity. The protection of life, the constitutionalist explained, is the supreme good.
Mr. Manitakis characterized the measure of imposing financial sanctions as absolutely necessary and appropriate. No one can claim that 100 euros is a coercive measure, assuming that low-wage earners cannot afford to be vaccinated.
“In this case, the state has exhausted all measures, it avoided all compulsory vaccination from April and March, preferring the strategy of persuasion and the option of vaccination when the opposition demanded vaccination for the entire population,” he added.
