“We were told that the woman has two daughters who have been locking her on the balcony and leaving for the last year. Her life was in danger. We called a locksmith and opened the door,” testified the police witness who was in charge of the incident.

A total sentence of nine months in prison, suspended for three years, was imposed by the Autonomous Three-member Misdemeanor Court of Thessaloniki on a 50-year-old woman, because she locked her 85-year-old mother on the balcony and left the house. The defendant was found guilty of exposing an elderly person and unlawful restraint.

The court recognized the mitigating factor of the previous conjugal life, while it decided that her appeal should have a suspensive effect on the execution of the sentence. The incident took place on August 12 in an apartment in Eastern Thessaloniki. The elderly woman from the balcony she was on started calling for help and the neighbors called the police.

“We were told that the woman has two daughters who have been locking her on the balcony and leaving for the last year. Her life was in danger. We called a locksmith and opened the door,” testified the police witness who was in charge of the incident.

He pointed out that the two sisters were searched. The accused – who lives permanently with the victim – did not answer the phone for three hours, while the other sister arrived from Preveza, within 3.5 hours, to give a statement.

“I have no complaints from my daughter. It was a bad time. That’s where I attribute it to,” said the 85-year-old mother, who testified with support, due to old age and health problems. “For the first time I stayed home alone. He takes care of me, I lack nothing. I have no complaints from my daughters,” he added.

In her statement to police read out in court, the other sister said of the accused that she “has no other means of living and lives with their elderly mother, who suffers from dementia. She lives on her pension and a rent. They told me that he left her alone on the balcony and the mother was calling for help. This has happened at least 20 times. I get phone calls every day. She doesn’t want us to send her to a nursing home because she will lose her pension,” testified the witness.

In her statement the accused, who stated that she is a doctor, explained that she has shared the family property with her sister. “1.5 years ago I came to Greece from America. My mother and I get along fine. I may be away for a few hours but I take care of her. I don’t have a good relationship with my sister. He does not come to bring even a plate of food. My mom wants to change the will. I have valuables that won’t fit in a safe so I locked it. I don’t want to lock her up in an institution because she raised us in the best way. I took responsibility for mom. The brakes are fine. I actually didn’t answer the phone. But I gave the key to open them” he said.

The district attorney requested that she be found guilty as charged.
