What to do if you are renting a home that is going up for auction

Advice from the Union of Consumer Workers of Greece to tenants in order to protect themselves in such a rental situation.

An issue arising in the case auction of a property, is the fate of the lease after it is done.

In its announcement, the Union of Consumer Workers of Greece refers to the options available to the tenant in order to protect himself in such a case of leasing.

Unfortunately, notes the consumer organization, after 1.1.2022, if the property which was auctioned was hired for business purposethe person who acquired it from the auction has the right to terminate the lease, in which case it is terminated after six months from the termination.

If again the property that was auctioned was leased as a residencethe person who acquired it from the auction also has the right to terminate the lease in which case the lease is terminated after six months from the termination.

In the case of a residential lease, the termination of the lease cannot be made before the minimum duration of a residential lease, which is three years, has elapsed.

Of course, it is understood that the new owner, if he wants, can continue the lease by collecting the rents since then, since with the auction he enters into the rights and obligations of the lessor.

We remind consumers that if the owner rents the property to a third party after the seizure (and before the auction) or simply grants the use to him based on another legal relationship, this can be terminated by the superior (the one who acquired it from the auction) within a period of two months from the transcription of the summary of the award report. Upon termination, this lease or other legal relationship is terminated after two months.
