Robbery after murder in a convenience store in Toumba: The first accused gets life, the second out of prison

Life imprisonment and an additional 11 years’ imprisonment was imposed by the Mixed Jury Court on a 28-year-old, accused of the murderous robbery against the 44-year-old clerk in a convenience store, in Toumpa, Thessaloniki. The same Court imposed a prison sentence of 4 years and 2 months on his 36-year-old co-accused, who was accused of keeping “chilis” outside the store.

The judges unanimously found them guilty, without recognition of mitigating factors, the first for manslaughter in a calm state of mind, robbery, illegal carrying and use of weapons and the second for complicity in the robbery and possession of drugs (for own use). Unlike the 28-year-old who returns to prison, the decision of the Court leads the other defendant to a status of freedom, on condition, until the Court of Appeal.

The victim was shot on contact, in his attempt to disarm the assailant, with whom he fought.

The 44-year-old ended up a few hours later at the AHEPA hospital, where he was treated with severe brain injuries.

According to the impeachment warrant, after committing his act, the 28-year-old ran to an adjacent street, met his accomplice and informed him of the unfavorable turn the robbery had taken, and then threw away both the weapon and the clothes he was wearing. By the same will, later the two defendants – who were friends and were drug users – met, with the 28-year-old foreigner giving about 100 euros to his accomplice, out of the total “booty” of 420 euros.

What did they apologize for?

“For the first time in my life I held a pistol. I couldn’t figure out how it happened. I had no intention of killing him. All I wanted was to secure money for my next installment. I was under the influence of various drugs for three days. After the incident, I made three suicide attempts,” said the 28-year-old, Albanian-origin defendant, apologizing for what happened. For his part, the 36-year-old (citizen) declared his innocence, saying characteristically that he did not participate in the robbery nor did he provide cover to the natural perpetrator.

“I learned about death from the radio”

Earlier, in a heartbreaking testimony, the 44-year-old’s mother told the Court that she was informed of her son’s death on the radio while she was on her way to the hospital in a taxi. “He was my only son, my support. Ever since I lost my husband he has vowed to be by my side. He worked the night shift because he said the pay was better. He died on the anniversary of his baptism,” he testified, among other things.

However, in the next 24 hours, the two defendants will appear before the Court again, as they are also accused of other robberies which they allegedly committed in an earlier period of time and for which they are asked to apologize to an investigator, as he said – speaking to APE-MPE – the 36-year-old’s lawyer.
