The acquittal for those tried for the scandal with Siemens’ “black funds”, which caused a sensation and reactions, is expected to be examined by the Prosecutor of the Supreme Court, Isidoros Dogiakos, in order to determine whether an appeal can be filed, possibly leading to a review of the case.
Mr. Dogiakos has requested the decision for consideration and has reserved his next move.
After all, the highest prosecutor has already intervened immediately after the decision was issued by ordering an investigation into who is responsible and how a significant part of the case ended up being subject to the statute of limitations, while with his written order to the competent prosecutor, he requests in addition to the search for any criminal responsibilities for the management of the long-term course of the case and investigation and another important part.
That concerns the laws that were passed, especially the changes to the Criminal Codes, in 2019 that changed the criminal environment and potentially affected the offenses that the defendants faced, contributing significantly to their statute of limitations.
“Furthermore, Mr. Dogiakos states in his order, check whether and to what extent the subsequent, from time to time legislative changes to the current Criminal Code with laws 4619 of 2019, 4637 of the same year and 4855 of 2021”.
Already, the Prosecutor of the Supreme Court has also ordered an expanded investigation about how the defendants in the Siemens scandal were acquitted (especially due to the statute of limitations) by immediately sending an order to the prosecutor with an explicit order “Investigate whether there is no case of acts or omissions, of a criminal nature, of persons in any way and in any capacity who were involved in the procedural manipulations of the case and significantly contributed to the statute of limitations of the punishable acts”.
