The court recognized the mitigating factor of subsequent good behavior and decided to redeem the penalty at 5 euros per day.
The 61-year-old (today) defendant denied the accusations and claimed the daughter was lying. She stated that he was pressuring her because she did not read and wanted to leave the house and take revenge on him. The separation with his ex-wife and mother of the little one also contributed to this, as he said.
When the district attorney suggested the defendant’s guilt, the sufferer burst into sobs and collapsed. She was escorted out of the courtroom by relatives.
In her testimony she described a traumatic experience for herself that was found to be true by regular judges and juries.
At first instance the father had been sentenced by a Joint Jury to a total prison sentence of 14 years and his appeal had a suspensive effect on the execution of the sentence.
