It will be revived before the Three-member Court of Appeal of Dodecanese on December 6, 2022 case with a 44-year-old accused Belgianwho was found guilty at first instance, without any mitigating factors being recognized for smuggling and for possession of a small amount of narcotics and was sentenced to 30 months and 10 days in prison, suspended for three years.
The 44-year-old man was checked on August 13, 2017 by customs officials after his arrival on the island by day boat from Marmaris and it was found that he was in possession of luggage containing two packages with two large type diamonds with the corresponding assessment of a special institution regarding authenticity.
Follow body check during which it was found that he had carefully hidden in various packages in his genitals, a package with 19 medium-sized diamonds, a package with 559 small-sized diamonds and a package with 58 pieces of jewelry (45 rings, 8 pendants and 5 pairs of earrings) .
In addition, a small amount of cannabis was also found in his possession.
The Belgian did not declare the above items and did not pay the corresponding duties and taxes, as a result of which he illegally possesses the above items in the territory and without the permission of the competent Customs Authority. He was thus imposed a multiple fee equal to three times the evading customs charges plus stamp duty and VAT in the amount of 33,491.71 euros.
The same apologist testified that he had bought the diamonds in Belgium and transported them to Turkey in order to turn them into jewelry at the country’s goldsmiths.
He chose to hide them in order not to enter the time-consuming process of checking their purchase documents in Belgium but also in Turkey, stressing that only a part of the jewelry can be substantiated.
He claimed during cross-examination that he buys second-hand jewelry, repairs it and sells it at online auctions.
The accused claimed that the 0.70 grams of cannabis, found in his possession, were intended for personal use and that he uses the cannabis for medical reasons at night, because he suffers from epilepsy.
