The cancellation requests filed by clubs and unions were rejected

The Plenary Session of the Council of State rejected the annulment petitions, which were filed by the Association of Greek Archaeologists, the Panhellenic Union of Antiquities Conservators, the Unified Association of YPPOA Employees, the Association of Temporary Archaeologists, the Panhellenic Association of Temporary Personnel YPPOA, the Hellenic Environmental Society and of Culture, the Christian Archaeological Society, as well as by private individuals, against the decision of the Minister of Culture and Sports, which approved the study of the removal and restoration of the antiquities of the Venizelos station of the Thessaloniki metro. The Plenary Session of the CoE rejected the applications with the 2560 and 2561/2022 decisions, which were published today.

As stated by the Minister of Culture and Sports Lina Mendoni, “Once again, with the decision of the Council of State, the choices and the policy of the Ministry of Culture and Sports regarding the matter of the Venizelos Station are vindicated. The project is progressing smoothly, within the schedules.

Prime Minister Kyriakos Mitsotakis will present to the people of Thessaloniki the project completed at the end of 2023 with five stations-museums, but also with the largest international archaeological site included in a major technical project”.

The Supreme Court of Appeal ruled as follows:

– Unanimously confirmed his jurisprudence, that the archaeological legislation allows the movement of an immovable monument, in order to build defense or other projects of vital importance for society and unanimously reiterated, once again, that these exceptional conditions are met in the case of the subway of Thessaloniki,
– Unanimously decided that the approval of the detachment and reinstatement study, the implementation of which is controlled by the competent archaeological services, is legally justified and that it was legally considered that this study should be specialized in subsequent stages, as indeed happened,

– Unanimously decided that the allegations about the fragmentation and deconstruction of the antiquities are not confirmed by the approved study, nor by the entire file

-With a minority of three members, it decided that the structure of the study in issues (auction, feasibility, etc.), is unnecessary in archaeological works that are part of wider projects or projects financed by other public or investment bodies, as these projects are subject in environmental licensing with wide publicity and consultation with the public, and the relevant archaeological studies and works are subject to the control and approval of the Ministry of Culture and its services, in accordance with the legislation”.
