Intellexa fined 50,000 for non-cooperation with the Personal Data Protection Authority

The Personal Data Protection Authority imposed a fine of 50,000 euros on Intellexa AE for non-cooperation with the Authority during its audit process.

The Authority finds that Intellexa’s representatives were unreasonably slow to respond to questions from the independent Authority and that they refused to provide information that is indisputably in their possession.

At the same time, the Authority continues to investigate cases of the use of spyware against persons who are in Greek territory, according to its announcement.

Furthermore, the Authority with its same decision (2/2023) requests the company in question to immediately hand over information it has at its disposal with the aim of completing the audit for this serious case.

The Authority, according to its announcement, “as early as July 2022, investigates cases of the installation of monitoring software on users’ mobile telephone terminals (spyware), with the aim of monitoring them without their knowledge as well as the subsequent collection and processing of personal data.

In the context of this investigation, the Authority has started an administrative audit of Intellexa SA from September 2022. An audit team of the Authority carried out an on-site audit both at the company’s registered office in Chalandri and at the company’s facility in Elliniko.

The Authority’s decision states that “the company unreasonably delayed responding to the Authority’s questions and refused to provide information which is indisputably in its possession, thus breaching the obligation of Article 31 of the General Data Protection Regulation which imposes on those responsible and performing the processing to cooperate with the Authority”.

At the same time, the Authority points out that “the audit of the company Intellexa SA is ongoing, while at the same time, the Authority continues to investigate cases of the use of spyware against persons located in Greek territory”.

Finally, for this purpose and within the framework of its responsibilities, it has collected evidence and information from various bodies inside and outside Greece and the EU, while continuing the investigation of the case.
