Yesterday, the MoE imposed a life sentence on the 42-year-old defendant, while at first instance, on June 19, 2018, by a majority, he was sentenced by the Mixed Jury Court (Criminal Court) of Larisa, to 18 years in prison. He also sentenced him to 2 years in prison for illegal use of a weapon, when he had originally been sentenced to one year in prison. An appeal against the first instance decision had been filed by the Larissa Appellate Prosecutor.
The MoE unanimously found the 42-year-old defendant guilty, while rejecting the mitigating factors that had been recognized at first instance, of his previous legal life and good behavior after the commission of his criminal act. The Court also rejected the request of the defendant’s defense attorneys to recognize the mitigating factor of the victim’s misconduct.
The defense counsel, lawyer Volou G. Sinelis, allegedly argued, among other things, that the perpetrator should be declared guilty of premeditated murder, while he proved that he had been convicted in the past, so he had no prior criminal record, while also in prison where he is serving his sentence. his sentence, he has committed disciplinary offences, so the mitigating factor of good behavior after the act is not applicable.
The defense attorneys, lawyers Al. Kougias, of Athens, and Despina Sveronis, of Larisa, reportedly argued, among other things, that the accused at the time of the murder was in the heat of a mental impulse and “what was done in the heat of a mental impulse was due to a confusion of his mental functions, due to the consumption of medicine” .
It is recalled that the brutal murder took place at around 9 pm on Tuesday, December 28, 2016, at Kolovos’ house, on Vas. Konstantinou street, in an apartment on the first floor. The 42-year-old was accused of stabbing the unfortunate 64-year-old 45 times, some deep and some superficial, with one fatal stabbing, after cutting the businessman’s throat. Returning from his home, at around 2:30 am on Wednesday, December 29, he had stolen the victim’s car and in his attempt to head towards Larissa, at the height of Aerinos, early on Wednesday morning, the vehicle had deviated from its course and was slightly injured in the head and leg.
After talking to a truck driver, who stopped to help him and to whom he allegedly offered 200 euros, to transport him, he left on foot, while another vehicle reached Velestino and then ended up home by taxi. He was finally arrested at 11 a.m. on Wednesday, December 29, 2016 by police officers of the Volos Security Directorate at his home. The 42-year-old allegedly claimed in his apology, among other things, that the victim “wanted something more from me”.
On the evening of December 28, he had gone to the 64-year-old’s house and, as he testified, saw him in his pajamas on a bed in the kitchen. After a while, according to the defendant, the 64-year-old approached him from behind, which caused the defendant to react. When the 64-year-old repeated the same movement, the defendant said it was “like taking the pin out of the grenade” and then he took the knife he found in front of him and caused the fatal blows to the 64-year-old. “I thought I was hurting my abuser, him, both of them together, I don’t know…” the accused had stated.
