On February 15, the judges of the Supreme Court will decide whether or not to close the case for the death of the little girl who died after an operation for “meatballs” at the Venizelio Hospital of Heraklion in December 2015.

As Cretalive had revealed, the case remains criminally “alive” after the intervention of the Prosecutor of the Supreme Court, Mr. Isidoros Dogiakos, who initiated the procedures for a possible reversal of the decision by which last November it appeared that the case was definitively closed at the criminal level .

Specifically, on November 25, the case for the circumstances of death of 4-year-old Melinas, after an operation for “meatballs” at the Venizelio Hospital, in December 2015.

The accused anesthesiologist had been acquitted in the trial court, but the prosecutor appealed against the acquittal and so the case would be tried again.

However, before the trial of the case in the second instance had well begun, the Three-member Court of Misdemeanors of Eastern Crete accepted the objection of the defense lawyers of the anesthesiologist, Alexandras Spanakis and Giorgos Steiakakis, with which they requested to dismiss the appeal which the prosecutor had brought against the doctor’s first-instance acquittal decision.

The defense requested that the proceedings not proceed, judging that the prosecutor’s appeal did not meet the conditions expressly defined by law for a thorough and fully reasoned appeal. The district attorney rejected the objection of the defense, but the court accepted it as such the case was closed before it began. The development came as a shock to the family who left the courts bitter, claiming that pretexts were not even kept.

At noon of the same day there was intervention of the Prosecutor of the Supreme Courtwho requested that the court transcripts be sent so that the prosecutor who would be “in charge” of the case would have an overall picture based on which he would proceed or not to file an appeal.

Finally, the deputy prosecutor of the Supreme Court, Mr. Christopoulos, filed an appeal and now the interest is focused on the decision that will be taken by the judges of the Supreme Court. If they accept it, the case will be heard again in the Court of Appeal. The hearing of the case has been set for February 15, when lawyers for both sides will discuss the legal side of the prosecutor’s appeal.
