The former officer in his apology denied the charge of domestic bodily harm, to note emphatically that “I declare that I am innocent”, while admitting that I only “insulted her”.
A retired EL.AS officer was found guilty of continuous domestic bodily harm by the Three-member Misdemeanor Appeals Court of Larisa, who was found guilty following a lawsuit by his now ex-wife.
The former officer and pensioner was today found guilty of domestic violence and subsequently found not guilty of attempted grievous bodily harm, while the charge of insult was filed, resulting in him being sentenced to 16 months in prison (suspended for three years).
The incidents took place in December 2015, February 2017, September 2017 and January 2018, when the ex-wife finally left their home in Trikala and – according to “E” information – was hosted for 25 days at the battered women’s hostel of the Municipality of Larissa.
In more detail, according to the indictment, the former officer is accused of “on the eve of Christmas 2015, in Trikala, inside his home, he attacked his estranged wife, grabbed her by the neck with his hands, pushing her violently towards the sofa, and then climbed on top of her and hit her on the left side with his fist her eye».
In February 2017, he attacked his estranged wife “the grabbed her by the neck with his hands, pushing her violently onto the bed and then climbed on top of her and cuffed her in the face, causing her physical injuries».
On 1-9-2017 «assaulted his estranged wife“, “grabbed her by the neck and dragged her about two meters, causing her to be hit in the waist by the balcony door knob“, as a result of which she was injured in parts of her body described in the indictment, which finally mentions another incident, which took place on 7-1-2018 when the former officer attacked his estranged wife, “grabbed her by the neck with his hands, threw her on the couch and punched her in the face».
During the hearing, the ex-wife described the incidents of violence against her, as also testified by an acquaintance of the ex-couple, also describing incidents, but also the character of the accused.
The former officer in his apology denied the charge of domestic bodily harm, to note with emphasis that “I declare that I am innocent“, while admitting that I only “insulted her”.
The defendant attributed his ex-wife’s attitude to the “instigation” of her relative and, referring to one of the first incidents, underlined that “I didn’t lay a hand on her, there was a verbal argument about our finances“, while another incident with an injury to the door, he attributed it to “directing”.
“For what reason would she slander you?” asked the president, with the defendant noting that the ex-wife “was telling me straight up that she was going to slander me.” He concluded his apology by noting his question that “five years have passed since 7/1/2018 when he left home, why is he still paying lawyers, suing me and asking me for 60,000 euros?”.
Clarifying that he would like money spent on court costs to be used for the needs of their family members, citing studies.
“From the hearing it was proved that the acts were committed, the crime has been committed” emphasized the District Attorney, noting the testimony of the victim and her friend to suggest the defendant’s guilt on the charge of domestic bodily harm and his acquittal for the attempt.
The former officer of EL.AS. apparently the court was not convinced, with the Three-member Misdemeanor Appeals Court of Larisa finding him guilty, imposing a 16-month prison sentence (with a three-year suspension), compared to the 2-year prison sentence that had been imposed on him at first instance.
