A 73-year-old man who, after an argument, shot and killed his 43-year-old son with a hunting rifle will be released from prison, according to the decision of the Mixed Jury Court of Thessaloniki.
The family tragedy took place in December 2021, in the village of Ryzia, Kilkis prefecture.
The Court sentenced the elderly man to a total of 7.5 years in prison, finding him guilty of manslaughter with intent in a calm state of mind, an act which, according to the unanimous decision of the judges, he committed beyond the legal limits of self-defense.
The defendant was recognized as having been pushed to commit the crime due to the victim’s previous inappropriate behavior (mitigator), while it was decided to serve the imposed sentence at home.
As emerged from the evidentiary process, the 43-year-old victim was facing problems of a psychiatric nature and was also a chronic drug user.
Testifying at the trial, family members described him as violent and dangerous.
As his mother characteristically said, in the past he had doused her with oil and set her on fire, resulting in burns on her body.
“I had come to terms with the idea that he would kill me,” said the woman, who was forced to live away from her son for ten years to escape – as she noted – his violent outbursts.
“My parents drew Christ’s Passion” one of the two sisters of the victim emphasized during her examination.
“He didn’t know my children, he was dangerous. He would kill innocent souls. If he lived in another family, he would be dead,” she testified, expressing her support for her father.
His other daughter took the side of the 73-year-old, reporting various incidents of violence against her parents.
Under the above circumstances, fights were almost daily even though the 43-year-old did not live in the same house, but often went to his father’s house.
After another fight, for a trivial reason, the victim beat up his accused father, only this time the 73-year-old – as stated in the indictment – took his hunting rifle, shooting once at his son, fatally wounding him .
“I was on the defensive” he apologized and added: “He moved towards me, shouting ‘I’m going to kill you… and I’m going to throw you out of the window'”. “I loved my child, at that time I felt like I was killing myself,” he added at another point in his apology.
After the court’s verdict – which keeps him out of jail as it was decided to serve his sentence under house arrest until the Court of Appeal – his two daughters fell into the arms of their 73-year-old father.
