The announcement of the Ministry of Environment
“Decisions of the KE.SY.PO.TH.A. regarding arbitrary constructions in the “Psarrou” area of the Municipality of Mykonos
The Council for Urban Planning Issues and Disputes of the Ministry of Environment and Energy (KE.SY.PO.TH.A.) examined on Thursday 4.5.2023 two open appeals, which had been filed against the demolition protocol of the head of the General Directorate of the Corps of Inspectors and Auditors H.P.EN regarding arbitrary constructions in the “Psarrou” area of the Municipality of Mykonos and according to the Conclusion – Autopsy Report of a Mixed Scale Audit regarding arbitrary constructions in the Panormos area of the island of Mykonos. The decisions of the KESYPOTHA, which concern the rejection and partial rejection of the appeals, respectively, were notified on Tuesday 9.5.2023 to the appellants. As part of their rejection, the arbitrary constructions are demolishable and the sanctions of articles 271 and 271A of Law 5037/2023 are applied, i.e. the imposition of construction and maintenance fines, criminal sanctions and suspension of operating permits.
In a letter to the Municipality of Mykonos, the prosecutor’s office, the region and the decentralized administration of the South Aegean, as well as the Ministries of the Interior and Tourism, the Y.P.EN. communicates the negative decisions and requests their immediate mobilization in accordance with the limited competence they have for all legal actions, e.g. suspension of the operating licenses of the specific businesses, demolition of illegal constructions, etc.’
The beach bar was sealed
The store today was sealed . As expected, the business side is going to turn against the decision of the Central Council of Urban Planning Issues (KESYPOTHA) and in fact immediately, seeking to “freeze” the process.
Thus, the next “episode” of the case will be written in the courts.
“We consider the decision of KESYPOTHA illegal. He has distorted the law and did not take into account any of our claims,” the company’s lawyer tells “KATHIMERINI”.
“We will exhaust every legal means so that its operation is not suspended. At the moment, 700 people are at risk of losing their jobs.”
The business side will immediately go to the administrative courts to file an application to annul the decision and ask for a temporary injunction, i.e. to “freeze” the process until the application for annulment is heard.
