Fines of 373,943.38 euros were imposed by the Competition Commission on medical technology companies following a Dispute Settlement process.

As announced, the plenary session of the Competition Committee, with its unanimous decision, during the Dispute Settlement process, accepted the relevant Dispute Settlement proposals submitted by the companies “VIOLAK INTERNATIONAL HOSPITAL EQUIPMENT SA, INEX SA MEDICAL HOSPITAL GOODS and BBD NIKOLAOS LAINIOTIS SA. B.E” – following a relevant recommendation – and imposed reduced fines, totaling 373,943.38 euros, for the violation found.

The case concerned the supply of medical technology products (rapid test) through a public tender. The above companies involved in the process, for which evidence was collected capable of documenting an infringement in the context of a horizontal partnership, expressed in writing their interest in investigating the possibility of being included in the Dispute Settlement process and filed a relevant request.

According to the rationale of the decision, the available evidence shows that the companies in question violated the law, following an agreement between them. “The violation lasted from 8.12.2021 to 03.06.2022 while it is recalled that horizontal partnerships are by object restrictions of competition”.

The full committee fined the above-mentioned companies for their participation in prohibited horizontal agreements and ordered them to cease, if they have not already done so, and to refrain in the future from the violations found.

Specifically, it imposes on “VIOLAK INTERNATIONAL HOSPITAL EQUIPMENT S.A.” fine of 98,234.50 euros, to “INEX S.A. MEDICAL HOSPITAL SUPPLIES” a fine of 149,316.44 euros and to “BBD NIKOLAOS LAINIOTIS A.E.V.E.” a fine of 126,392.44 euros. In other words, a total of 373,943.38 euros of fines were imposed for the violation found.
