Thessaloniki: 37-year-old will be tried for a crime – Pink videos and photos of his ex-boyfriend’s leak leaked

The case of the three-member Criminal Court of Appeal of Thessaloniki leads to a case of publication – via the Internet – of material with sensitive personal data and a 34-year-old victim.

The Misdemeanor Court of Thessaloniki, before which the case was examined, with a 37-year-old accused, evaluating all the evidence, ruled, by a majority, that the act should be dealt with in its criminal form and therefore should be judged by a higher Court. The change of charge, “as a more correct legal characterization”, had previously been requested by the prosecutor of the headquarters. “Objectively, the act has the purpose of harm. That is why it should be treated as a crime,” he said in his speech.

According to litigants, the court followed the reasoning with which a criminal prosecution was recently announced, against TV presenter Stathis Panagiotopoulos, for the well-known case with the leakage of a pink video of his ex-sexual partners.

The case of the 34-year-old arrived in Justice after a lawsuit she filed in the Cybercrime Prosecution of EL.AS. Following an investigation, the 37-year-old, who maintained friendly relations with the prosecutor’s ex-partner, was referred to trial. He became a defendant when the prosecuting authorities, following his electronic traces, identified suspicious digital “fingerprints” that were connected to the material in question.

In his apology, he denied the act attributed to him, as well as the allegation of the complainant’s ex-partner that he had stolen the specific material from his computer. “I have never owned or uploaded videos or photos of the victim,” said the 37-year-old, stressing that he is being unjustly accused.

The 34-year-old former musician described in court the broadcast she has been experiencing in recent years, saying that she was financially and professionally ruined, while appealing to the judges to protect her. “All these years I have been trying to collect the uncollected,” she said, referring to the irreparable damage her personality has suffered.

The case file refers to personal photos posted in early 2016 on social media and to an account bearing the artistic name of the complainant, while videos of her sexual content were leaked to a pornographic site. According to the photographic and video material, they were “taken” “against her will” and “in moments of weakness” by her ex-partner (with whom she had a relationship until 2015).

The latter was accused of possessing the specific material and was acquitted, but after a new lawsuit against him for leaking personal data, he was referred to trial again.
