For the homophobic comment of the mayor of Volos
By Ioanna Mandrou
Prosecutorial intervention for the statements of the newly elected mayor of Volos, Achillea Beu, was manifested at the highest level by the Prosecutor of the Supreme Court, Georgia Adelini.
The Supreme Prosecutor sent an order for an investigation against Achillea Beu based on the provisions of the anti-racism law emphasizing in her document that his reason for the specific statements that caused a storm of reactions, is racist. “In other words, it is stated in the prosecutor’s order, it must be investigated whether the above statement of the Mayor was suitable to cause discrimination, hatred and violence against a group of persons determined on the basis of sexual orientation, and specifically against homosexuals (see also AP 858/2020)”.
In another part of the prosecutor’s order, Mrs. Adeilini calls on the competent prosecutor’s authorities to examine the case to appeal to the courts, that is, to file a lawsuit against the president of SYRIZA, Stefanos Kasselakis.
It is mentioned in the prosecution document.
“In any case, it should be investigated whether the President of SYRIZA-PROGRESSIVE ALLIANCE wishes to file a summons against the aforementioned Mayor for insulting with racist characteristics, etc.”
The order of the Prosecutor of the Supreme Court in detail
“Please, in view of the statement of the Mayor of Volos, which took place yesterday in a live broadcast by most of the nationwide channels, with the following content: “So, Mr. Kaselakis, are we going to raise girls to produce poustides? This is Greece, is this his homeland? leave me alone Under no circumstances will you be a model, to investigate any commission of the criminal act of article 1 par.1 of Law 4285/2014.
It should, among other things, be taken into account that the above statement of the Mayor in question, interpreted as a single meaningful set, in accordance with the ECtHR’s jurisprudence, targets by identifying in a completely distinct way the persons who belong to the group of homosexuals, in and those persons with the specific sexual orientation are denied the right to exist in society, to participate, to act and to express their perceptions and aspirations in social life.
Therefore, his specific behavior can incite hatred against homosexuals, as the intensity of his speech, even public, taking into account the status of Mayor, can be considered suitable to cause the average person strong feelings of loathing, revulsion, condescension, revenge and particular hostility against the above group of persons, and these feelings are objectively possible to cause a risk of committing acts of violence against the specific group or its members, disrupting the peaceful and orderly social coexistence and their individual rights. In other words, it must be investigated whether the above statement of the Mayor was apt to cause discrimination, hatred and violence against a group of persons determined on the basis of sexual orientation, and specifically at the expense of homosexuals (see also AP 858/2020).
In any case, it should be investigated whether the President of SYRIZA-PROGRESSIVE ALLIANCE wishes to file a summons against the aforementioned Mayor for insulting with racist characteristics, etc.”
