The new defendants – eight in total – among them the two sons of the mastermind of the case, were acquitted by the will of the Athens Criminal Council of the charges they faced, which included robbery and murder.
In the reasoning of the parliament presented by Patris newspaper the prosecutor’s proposal is adopted which also acquits the accused, while after an investigation by the judicial authorities through communications, testimonies and itineraries, no involvement of the accused in the abduction and murder of Marios Papageorgiou emerges.
Witnesses corroborated the claims of two defendants that a trip that came under the microscope of the authorities was to sell charcoal and that it was not true that they transported and buried Mario’s body. The prosecution’s proposal states, based on witness statements: “During the critical period of Mario’s abduction, at least the period from August 7 to 15, 2012, he (s.s. K.G) was visiting with his family in a village, near Burnt Vourla. Obviously, by the logic of the criminal, the accused would not entrust the transfer of the body to someone who had not been involved in the operation from the beginning as this would expose him to a serious risk of disclosure. But this logical argument in this case, is not supported by a specific evidence in order to produce the indications required by law for referring the accused to the Hearing.
For K.M, it should similarly be accepted that there are no serious indications of his being referred to the audience as it appears from the recorded conversations that he always acted together with K.G and in fact the latter always had the initiative or was the intermediary of his communication with PM (s.s. brain)”.
“The sons of the brain are not guilty”
The prosecutor’s proposal is clear for both sons of the brain: “There were no serious indications for their referral to the Audience, that they were physically present at the scene of the murder or abduction of Mario or even that they participated in any criminal way in the commission of the offenses in question. In particular, the fact that MP is the last person to call Mario on the phone at 9:54 p.m. on 09.08.2012, and in fact located in _Nea Smyrni Attica (as shown by the activation of antennas), does not constitute a catalytic element as it obviously does not correspond to any logical criminal especially if it is taken into account that this happens to be a police officer who serves in the highly prestigious security services of ELAS, to communicate with a victim by phone shortly before such heinous criminal acts took place against him.”
The action of the brain
In the will, the role of the mastermind of the case is revealed, but after so many years, the question of the whereabouts of the body of the unfortunate Mario remains unanswered.
P.M. met Mario’s family in 2002 and as he typically states:
“Due to the single-parent nature of Varvara Theodorakis’ family and the common origin with that of P. M from Mani Laconia, P. M had imposed himself on the family as a protector, advisor and above all he displayed the missing father figure in Mario, as a father model . Taking advantage of Mario’s respect, trust and need to have a person to protect and advise him, he accompanied him to the various workshops and car sales companies since Mario had a great love for cars. P. M having a wide circle of acquaintances in various public authorities, such as the Police, but also in various political areas had created not only in Mario but also in his mother and their relatives and friends the image that he is the man for all jobs, which has the ability to solve their various problems immediately.
All of Mario’s environment and apparently himself considered that P. M is the great man, necessary in the secret services and the Police and his speech and his orders have the character of orders of a state official working under special secret conditions and preventing by creating this “avatus” avoiding strange questions but also preventing any suspicion as to his character and his actions. Essentially, P. M did not work, did not submit a tax return, had a comfortable life and even loaned sufficient sums of money to other people.”
The mastermind of the case decided to trap the unfortunate Mario, who was on vacation with his mother in Diakopto, Achaia, under the pretext of selling a device that August, and to give him an appointment in Megalo Pefko Attica. There, the mastermind along with at least 3 other people: “He was repeatedly hit on the head with his car’s fire extinguisher, resulting in the loss of a significant amount of blood, and was trapped in the trunk of the car in the spare seat during his last moments.”
The reaction of Mario’s family
The exculpatory will for the 8 defendants, with which the restrictive conditions are abolished, caused the reaction of the family of the unfortunate Marios. His mother’s lawyer, Nikos Roussopoulos, told Patris newspaper:
“We will appeal to the Athens Appeals Prosecutor to appeal the acquittal since elements mentioned in the decision of the Mixed Court of Appeal of Athens and which had troubled the court at the time were unfortunately not investigated in the interrogation. It is characteristic that the brain son knew that Mario’s car is abandoned by the kidnappers in Paleo Faliro while the kidnappers had not yet contacted the mother? This case must come to an end so that this mother can be put to rest and the full truth can be revealed.”
