The case began to concern the prosecuting authorities of our region in the summer of 2016 and on February 7 the 46-year-old will be tried in a second instance, in an attempt to reduce or even “disappear” the heavy sentences imposed on him at first instance.

More specifically, the case in which a 35-year-old man of Italian origin is related, who is related to the 46-year-old (uncle and nephew), was heard for the first time in April 2019 by the Mixed Jury Court of Kos.

The court, accepting the independent allegations of the defense attorney Mr. Akis Dimitriadis, imposed a total sentence of 11 years imprisonment, one month imprisonment and a fine of 2,000 euros with the appeal having suspensory effect on the 46-year-old and the 5-year sentence of 5 years imprisonment. euros per day with the appeal also having suspensory effect.

In particular, the 46-year-old Italian man who was finally charged with attempted murder, this charge was converted in the court of first instance into dangerous bodily harm and he was sentenced to one year in prison, for the distinguished form of kidnapping he was sentenced to 10 years in prison, for drug use 4 months imprisonment, for possession of a weapon in imprisonment for one year and a fine of 2,000 euros and for use of weapons 6 months imprisonment, ie by merger, a total sentence of 11 years imprisonment for one year and a fine of 2,000 euros.

As for the 35-year-old nephew, he was found not guilty of attempted murder, largely innocent of the charges of carrying and using a firearm, and found guilty by a majority of the basic principle of abduction, an act for which he was sentenced to 5 years in prison. years converted to 5 euros per day.
The 46-year-old was appealed against this decision and so his case will be heard next week by the Mixed Jury Court of Appeal of Dodecanese.

The escape and the report to the police

It all started in the early hours of July 25, 2016 when police officers of the Rhodes Security Sub-Directorate went to a street in our city for an injured person who had escaped from his captors.

It was about the 38-year-old foreigner of Albanian origin who complained to the police that at 5 o’clock in the afternoon of the previous day, two of his Italian acquaintances invited him to the store that operated in the city of Rhodes. There they stopped him, gagged him, tied his arms, legs and neck with rope and cable, took him to a store warehouse, beat him with knives and an ax, while electrocuting him with a “taser” evacuation device.

The Albanian had also complained that around 3 in the morning on July 25, the 46-year-old Italian left the store, leaving the 35-year-old to supervise him. An hour later, the Albanian, taking advantage of the fact that the 35-year-old had fallen asleep, managed to escape, went out on the street where the police finally located him.

After the complaints, the police went to the 46-year-old’s shop where they located the 35-year-old, arrested him while they found and confiscated three knives, an ax, a taser, a rope and a corduroy, as well as a Bermuda shorts, a T-shirt and a handkerchief with which the 38-year-old Albanian said that he had been gagged.

This was followed by the arrest of the 46-year-old Italian, who was located in his house, while in the possession of the two men, a total of 35 drug pills were found and confiscated.

As for the 38-year-old, he was transported to the hospital of Rhodes for first aid.
A case was filed in the case, with which the two Italians were brought before the competent prosecutor of the Court of First Instance of Rhodes, who prosecuted them for attempted murder with intent in a calm state of mind, direct complicity in this crime, distinguished kidnapping in order to passions in an act for which he had no obligation, committed in collusion, carrying and using weapons and possession of drugs.

According to what the 38-year-old foreigner allegedly testified to the Rhodes investigator, about what happened in the warehouse of the 46-year-old Italian’s shop on July 24, 2016, it all started on the occasion of the money he had given to buy and sell a two-wheeled motorcycle!

The initial sale price of the vehicle by his brother-in-law – as the Albanian said – was 4,500 euros, but in the end, as the Italian did not have that much money, they agreed on 3,500 euros, of which he gave 2,500 and the remaining 1,000 euros he would give later.

The Albanian stated categorically that he never entered the Italian’s house and stole money or jewelry and clarified that he was tortured by the 46-year-old Italian, while his 35-year-old nephew had no involvement other than the fact that he was holding a knife in the 38-year-old’s body as his uncle had suggested. in order to remain immobile.

He himself spoke about the phone calls made to two other people in order to bring the money to be released, while he pointed out that it was solved and he managed to escape on his own.

The 38-year-old had stressed that he was tied up as he was found by municipal cleaning staff, who released him and notified the police, while he added that all this and his torture are recorded in video from a closed circuit television, which was given to the police.

They deny the allegations

On the other hand, uncle and nephew deny the accusations as they are attributed to them, while it is worth noting that only the 35-year-old appeared before the Kos Mixed Jury Court, while the uncle was represented by Mr. Dimitriadis’s lawyer.

The two involved from the first moment stated that the case is completely different and specifically, apologizing to the investigator of Rhodes, they had claimed, among other things, that the 38-year-old Albanian had threatened the 46-year-old Italian that he would kill him as well as his family. they had said and which have nothing to do with the allegations of the foreign complainant.

More analytically, according to information, the 46-year-old Italian had repeated that the Albanian had stolen money and jewelry from him a year earlier. He denied that he had been abducted and had said that the 38-year-old himself went to his shop where he was vindictive and aggressive and at some point took a knife from the kitchen and attacked the Italian. The 46-year-old then tried to defend himself and even stated that he had received knives in the back over his shirt which left marks on him and that there was a relevant forensic report confirming this.

The 46-year-old foreigner had also said that at some point he hit the Albanian in the nose and he was stunned and then he took a cable that he found in a clipboard and tied it because he was scared, as he threatened to kill him. Then he tied his legs, while as he was afraid that he might have other compatriots who were waiting for him, he gagged him so that he would not shout.

The 46-year-old had added that he was afraid of the Albanian’s threats to himself and his family, so when his nephew arrived at the store at around 8.30 pm, he informed him of what had happened and left to make sure his family was well. . He had even added that he told the 35-year-old to leave the Albanian after midnight in order to calm down first. He had also referred to the testimony of the Albanian, who had said that it was false for the most part, as on the one hand he did not owe money for the machine he had paid for and on the other hand none of what happened was as described by the complainant.

The 35-year-old nephew, who had apologized, had stated the same things to his 46-year-old uncle, he had denied that he had ever threatened the Albanian with a knife, even clarifying that the 35-year-old is much taller than him, who also receives medication as he suffers from mental illness. .

As for the possession of the weapon, both men had stated that it was a kitchen knife and the drug pills, that the 35-year-old was taking part of them due to his health problems and the rest belonged to the girlfriend of the 46-year-old Italian and there is a prescription which he presented.

Following the completion of the apologies with the consent of the prosecutor and the investigator, both men were released on the restrictive conditions of being banned from leaving the country, appearing twice a month at the police station in their area and paying a bail of 5,000 euros for the 43-year-old Italian and 1,000 euros for his 32-year-old nephew.
