They were found not guilty yesterday by a unanimous decision of the Mixed Jury Court of Kos after an exculpatory recommendation by the District Attorney, two relatives of the 85-year-old who succumbed on November 11, 2015, in the intensive care unit of the General Hospital of Rhodes.

Accused for 8 years were the victim’s 58-year-old daughter and his 31-year-old grandson who had been released with the restrictive conditions of paying a cash guarantee of 5,000 euros, being prohibited from leaving the country and appearing three times every month (on the 1st, 11th and 21st) at the police station of their place of residence.

They were specifically accused of what happened on Hatziantoniou Street in Ialyssos, in the early hours of Monday, November 2, 2015 and at a time that was not precisely determined, they entered their relative’s house and caused him head injuries, chest and abdominal injuries, shoulder and thigh fractures with their hands, with a kitchen knife but also by throwing him from the balcony into the uncovered area of ​​the building.

Apologizing from the first moment, they indignantly denied the whole charge against them. They expressed their deepest sorrow and pain at the loss of their loved one and the subsequent loss of his wife, who was suffering from dementia.

They pointed out that both the initial forensic report and the post-mortem forensic report show that the 85-year-old’s death and the complexity of his injuries are due to his fall from a height and a suicidal tendency, due to the disorder from which he suffered .

As the forensic autopsy-necropsy report typically states, “the wounds found externally on the chest and epigastrium were caused by a knife and a cutting instrument. The overall picture of the above wounds (severity, location – distribution) IS indicative of provocation by the same person in the context of a suicide attempt”. They stated that they have nothing to do with the charges against them, which have now been dismissed by the aforementioned forensic autopsy report.
It is noted that the police officers of the Security Sub-Directorate of Rhodes judged from the evaluation of the witness statements, which were received and further from the data collected by Simanis, which were sent for DNA testing, to the Directorate of Criminal Investigations of ELAS, that there had been a struggle inside the victim’s apartment and further that an effort was made to clean the area.
From the forensic report, however, it is alleged that there was no struggle after the control of the accused.
