“Studying the case file, it appears that the operation of the OSE is a miniature of the public administration. OSE could have a bright future, but it has the crap that we all know about and the tragedy of Tempe. It’s a shame, it’s tragic, it could be laughable that an operating regulation ends up in a rumor and this management has the most unfortunate results”, emphasized the prosecutor of the headquarters, among other things, suggesting the guilt of two former heads of the Larisa Directorates of the OSE.
The two former executives of the OSE were found guilty by the Three-member Misdemeanor Appeals Court of Larisa where they were referred accused of manslaughter in connection with the fatal wounding of the 15-year-old student, Konstantinos Babaniaris, who was “struck by lightning” by the overhead power lines of the OSE at the Commercial Station Mezourlou, early in the evening of Saturday, October 14, 2017.
With the court, as in the first instance, to impose a prison sentence of 18 months (with a three-year suspension) on the two former executives, recognizing the responsibilities of the Railway Organization for not taking safety measures, a decision which (s.s. as in the first instance) refuted one of the main claims that the OSE was not responsible for the tragic development, but the responsibility belonged to… the 15-year-old himself who was in a prohibited area.
With the district attorney, underlining the “unfortunate results” from the management of the OSE, disproving the argument of non-responsibility of the executives of the OSE and characteristically noting that “the child had no business being there, but he was finally found” emphasizing that “the defendants committed the act, as was also recorded in the first instance.”
The same dimension was raised at first instance by the prosecutor of the Three-member Criminal Court of Larisa who asked herself “is the child responsible and is not an AE?”, adding that “where the OSE is called upon to assume some responsibility, it assigned it either to the minor – or to the military principle”.
