The lawyer Achilleas Emilianidis was hosted on the Sigma channel, who referred to the legislation passed yesterday by the Greek Parliament for same-sex couples.
Mr. Emilianidis explained what will happen in cases where a couple goes to Greece to get married and their marriage will be valid in Cyprus.
He initially stated that it is considered a breakthrough because it is the first time such a law has been passed. “It’s an issue that continues to divide society.”
He made it clear that marriage is a human right. “When the Human Rights Convention was made, a provision was made that marriage is the union of a man and a woman. For this reason the European Court of Human Rights had declared that there is no human right of same-sex couples to marry because the legislator in the 50s had said about man and woman. This also applies to our Constitution.”
He added that after the Human Rights court he had said that “there is an evolution of social conditions. I cannot go against the letter of the Constitution, but that does not mean that I do not recognize the development.”
Asked about the cases where a same-sex couple from Cyprus goes to Greece to get married and have a child there, when they return if the marriage and the child will be recognized, he explained that once their right has been recognized they cannot deprive them of their rights”.
