2 years imprisonment with a three-year suspension imposed by the Joint Court of Appeal (JOC) Larisa to a 38-year-old man from Larissa, who was in the defendant’s dock, as after a verbal confrontation he slapped his hand against 44 years old on the occasion of occupying the entrance to a parking space.

After a marathon session that ended at 9.30 last Wednesday night, the 38-year-old was found guilty not of the offense of grievous bodily harm for which he had been referred, but of dangerous bodily harm, after according to information from “EtD” the jurors accepting the request of the defendant’s defense, they voted with the majority against the judges (by a vote of 4 – 3) resulting in the charge being reversed.

The two from Larissa were in court on the occasion of an incident that occurred shortly before 6:30 in the afternoon of September 29, 2017.

In particular, the 44-year-old, returning from some work and while she was expecting a relative, attempted to temporarily park her car in front of the entrance to a parking space, owned by the 38-year-old, in a multi-storey building on the main street of Larissa.

At the same time, the 38-year-old man was at the entrance of the apartment building, waiting for a transport company to transport his household goods.

The verbal confrontation took on other dimensions, when – according to the indictment – “the defendant punched the victim in the face” who, due to her surprise and the severity of the blows, lost her balance and found herself on the ground, where the defendant “continued to hit her with particular severity, successive punches and kicks to the skull, face, neck, neck, chest, abdomen and cervical spine.

When the victim managed to stand up, the accused punched her again in the face, throwing her to the ground. When neighbors and passers-by managed to remove him from the patient, while the latter was being supported and was already bleeding from the mouth and nose, the defendant kicked her again.”

The indictment also describes in detail the injuries the 44-year-old suffered from the beating, as well as the operation she underwent to restore her health.

In the context of the hearing, among other things, the victim testified and described what she experienced that afternoon, while the defendant’s lawyer, who was not present as he was represented, noted, among other things, that the 38-year-old struck the 44-year-old, but not with “intensity” described by the sufferer.

The district attorney found the defendant guilty on the charge of grievous bodily harm, but the four jurors overruled the three regular judges.

As a result, the charge was changed and the 38-year-old, having been unanimously found guilty, after the recognition of a mitigating factor, he was sentenced to 2 years in prison, with a 3-year suspension. It is noted that the 38-year-old was found guilty by the majority in the first instance by the Volos Magistrate’s Court, which imposed a prison sentence of 3 years, also suspended.
