The 39-year-old son of the family, who was initially found not guilty due to doubts, is back in the accused’s dock
The case of the murder of the 25-year-old domestic helper from Sri Lanka, whose body was found on February 2013to float in the pool of the luxurious house where he worked, in eastern Thessaloniki.
From the findings of the medical examiner it emerged that the 25-year-old immigrant he was strangledwhile according to prosecution documents, the motivation of the murder it was alleged to have been sexual.
After a long-term investigation by the Police, criminal charges were brought against the 34-year-old in 2020 for “intentional homicide in a calm state of mind”.
On the accused’s bench sits again 39 years olds (today) son of the family for whom the victim worked, who had been declared not guilty beyond reasonable doubt at first trial, which took place before the Military Court, in October 2021.
However, the acquittal was overturned at the Supreme Court following an appeal filed by the victim’s mother, which was accepted by the Supreme Court of Cassation. Consequently, the case was returned to the Military Court (which is responsible as the defendant was serving his military service during the disputed period), with a different composition of judges – military officers.
At the beginning of the evidentiary process, the 39-year-old defendant denied the act of intentional homicide attributed to him, declaring his innocence, while expressing his “great sadness” for the victim. Afterwards, the 61-year-old mother of the victim, who worked for several years in the same mansion, took the witness stand.
The trial is ongoing.
In the reasoning of the appeal, it is stated, among other things, that the (acquittal) decision contains “references and contradictions of a circumstantial nature, which create ambiguities and logical gaps, so due to insufficient reasons it lacks a legal basis”. Also, as it is underlined, the Court “is not certain that it took into account and took into account the entire content of the cited evidence, from the combined evaluation of which the guilt of the accused was safely proven”.
