Unconstitutional and contrary to the separation of powers, five members of the Board of Directors of the Union of Judges and Prosecutors, in their announcement, characterize yesterday’s action by the Deputy Minister of Justice Ioannis Bougas to address recommendations and instructions to the administrations of the courts and the Prosecutor’s Offices of the country.
In more detail, the five judicial officials point out in their statement that “yesterday’s intervention by the Deputy Minister of Justice Ioannis Bougas, through his document No. and of the country’s Prosecutor’s Offices constitutes a direct interference in the work of Justice and a violation of the principle of the separation of powers of the state”.
At the same time, the five request “the immediate revocation of the above document and the restoration of constitutional legitimacy”.
The ENDE Board Members who sign the announcement are Margarita Stenioti, Efstathios Vergonis, Konstantinos Voulgaridis and Nikitas Velias.
Previously, the prosecutor of the Supreme Court, Georgia Adelini, on the occasion of Mr. Bouga’s document, in her statement, among other things, said:
“3. We also emphasize that judicial independence is the foundation of our democratic state and ensuring it is the duty of all of us, excluding any intervention by the other two powers, for whatever reason and whether it is attempted, even to deal with existing and serious problems, as in this case case.
4. Finally, in accordance with the Constitution (articles 87 et seq.), the Prosecutor of the Supreme Court and all prosecutorial officers are included in the judicial function of the State and enjoy personal and functional independence.
Consequently, according to the above provisions, the responsibility for the proper functioning of their Services belongs to the Directors of the Country’s Prosecutions and by extension to the Prosecutor of the Supreme Court”.
